Is there anyone expert in copyright issues?

 

I want to use the following image in one of my book. Found it in pinterest and wordpress. Already sent message to ask the wordpress site whether I can use the image.

trying to log on to www.bithslapped.co.uk but couldn't found/access to the website. a lot of website review info of the website.

 

Is it safe for me to use the image still? Can anyone advise me?

Better to seek permission/license. Copyright subsist 70years after the death of the creator. Especially you’re intending to use it in your book, which I suppose it will be published and sold in the market, better protect yourself. Why don’t you create one yourself. 

 

If you gonna use it, how much of the content will be based on that pic? If the creator wants to pursue his infringement rights, it will be based on the portion of you sales/profit on which that pic out of the whole book. Of course there are many grounds of argument.

I have made another version of it. but its too similar. Should have make more drastic changes. will I still get sue? If you were the owner of the pictures, will you still sue me?

A lay man can tell u that this is OBVIOUSLY a duplicate of the original. You don't need a judge to tell you that! I will sue until your pants drop! :)

What if I recategorize them? There are actually 4 categories of them. first chart with 1st category of 4 positions. 2nd chart with 2nd category of another 3 positions. 3rd chart with 3rd category of another 4 category. and the last chart with the remaining positions.

 

My model has bigger boob and nice pony tail hair. and by dividing them into 4 sub chart. Do you think, you will still want to sue me? :D

try to find an image that is covered by creative commons license then

you can edit or even use it whole sale, im sure you can find one,

since these poses/images are not owned by one person

for those who are unsure, be it youtube videos or fb posting, tumblr or whatever, always check w the orginal source again and again

some organisations are very strict, they wont want their staff event/co. photos taken by organisers, neither do they want to  use videos of other sources, they prefer to use their own sources/production
Which is why u saw on tv programmes, even brands of the t shirts and brands of certain labels are all masked

one has not even face copyright issues of a museum organising an art competition for kids and students, who own the copyright? the museum, the organisers that help the museum, the kids or students who signed on a form to participate but didn't...........
