We have prepared a petition regarding the 2018 review of the Singaporean Penal Code. Our petition and its supporting signatures will be delivered to the Penal Code Review Committee and local Members of Parliament by September 24, 2018.

Section 377A is a colonial law that criminalises consensual sex between men. In the past, Singaporeans have been charged, convicted, and punished under this law. Even if it is not actively enforced, the law still punishes our gay friends and relatives by signalling that what they do, and who they are, is condemnable and wrong.

On 6 September 2018, the Indian Supreme Court struck down Section 377 of the Indian Penal Code for being unconstitutional. In his judgment, India’s Chief Justice opined that “Indian citizens belonging to sexual minorities have waited. They have waited and watched as their fellow citizens were freed from the British yoke while their fundamental freedoms remained restrained under an antiquated and anachronistic colonial-era law − forcing them to live in hiding, in fear, and as second class citizens”.

How much longer must gay Singaporeans live as second class citizens; branded criminals by laws meant to protect all Singaporeans?

We are ready for a Singapore that treats all her citizens equally. We are ready for a Singapore that respects all minorities equally and promotes individual choice and dignity. We are ready for a Singapore where people are not afraid to simply be who they are.

The Government is undertaking the first major review of the Penal Code in more than a decade and the three-week public consultation on the report of the Penal Code Review Committee ends on Sunday September 30, 2018. The proposed changes to the Penal Code are expected to be tabled in Parliament in November this year. Unfortunately, an executive decision by the government was taken to exclude Section 377A from the scope of the review.

If you share our vision of a more tolerant, more equal Singapore, please sign this petition and speak out. The time for change is NOW.

3. It prevents Singapore from being a truly pluralistic society that protects the interests of its minorities.

4. Our laws should be secular and outside the influence of religious overreach.

5. The policy of non-enforcement is vague and arbitrary, and undermines our rule of law.

The rest of the world has made progress in correcting this unjust colonial imposition, and Singapore must not be left behind on the wrong side of history.

If everybody do not sign and keep quiet 377A will stay in Singapore forever. Remember 377 was once repealed and turned into 377A because some people work on it

Everybody needs to work on this for a better tomorrow. If it does not happen in our lifetime at least it happen for the sake of future generation

 

I normally do not care much about politic but the pro 377A is a bunch of S*%* that do not use brain to think. Everybody brainwash one another to keep 377A

 

It is a outdated code that is left by the British for its colonies - it is no longer relevant and the list of countries keeping it are mostly 3rd world countries which in this case unfortunately including Singapore.

Sg is only first world in economy related area but in many other areas, it always fall under 3rd world countries category.

It's not turned into 377A. 377A was part of 377. They repealed everything under 377 including the main section 377 except 377A. The act of not repealing 377A only is already discriminatory.

Guest Not awake this govt

Woah the govt had decided a month ago the reveal committee's convening agenda. They include repealing the crimes of suicide and matrimony rape (which is long overdue imo), but no scraping of death penalty and 377a!

 

Woah woah.... Hold on, wait a minute here... What's wrong with them? Why are the protection of sexual minorities not important as women and children? LGBT didn't decide to be who they are and suffer the discrimination and bullying just like children and women in abusive families didn't ask to be abused.

 

Why can't they empathize for once, for people who could be their friends or relatives who may practically exist in higher numbers than abuse victims? 

 

Discrimination and hatred against sexual minorities should be made a crime instead!

Best not to look at past or existing social practices for any kind of logic or sense. We live in a society that thinks of itself as pro-life, but its okay to show children movies where people are being gunned down, but oh heaven forbid we should show them a penis or a vagina. We think we learn from history, but our textbooks only have the names of wars, but not of peace. Let's just get our own damned rights for ourselves and forget what other people say or think is right or wrong because clearly nothing about our history shows that we have been capable of judging that logically.

Singaporeans need to be educated that gays are born homosexual, however much the religious types like to brainwash and insist that we are not.

 

Both heterosexual and homosexual are natural sexual inclinations occupying spaces on the sexuality spectrum.

 

Just because you were taught certain ideas from young doesn’t mean those ideas were based on truths, and not ignorance, prejudice or hate.

 

Just because you feel disgusted and repulsed by something doesn’t mean they are inherently immoral or wrong and deserve to be condemned and criminalised by society’s laws.

 

Singaporeans need to learn to be less anal retentive and uptight by learning to embrace people who are borned differently from them.

 

We are all the same human species with same hopes, dreams and fears.

I would rather say: Is Singapore a secular country or not?

This is the more relevant point. Either you allow religion to crawl into the justification of laws or not.

It should be not and from that point of view 377A has no basis and is discriminatory.

Right.  A big diversified country like India with hundreds of different languages, culture backgrounds and deep seated religious beliefs can do it, what is Singapore ?

I can't sign as I'm still a foreigner here - would love to see 377A go though.  Would prefer removal via courts/constitution as this would be more robust than a simple repeal by parliament.

 

Need to convince conservatives that even though they may disapprove of acts contrary to 377A, the private business of minorities should be protected.  In particular, nothing is being forced down their throat - they are still free to express their disapproval.  After all, almost everyone is going to be part of a minority on at least one issue.

“I live in Taiwan now and we are among the first to pass laws in support of gay right. Not sure where the marriage right progress now (as it will demand revision on civil law governing marriage) but that has made negative impact.

The school registration form no longer keeps address of mom and dad, but reads spouse 1, spouse 2. Schools and public facilities are required to put up gender friendly restrooms, ie guys share the same bathroom w girls. And primary school kids are taught to be aware of their sexual inclinations and respect impulses and how to have safe sex early on.
It is against the law not to teach accordingly and teachers will get sued...

It is become a political means to curry favor of growing LGBT minority population. What has become an innocent sympathetic act has backfired on our future generation and education. Very difficult to go back now...

Oh yes Stanley, I am very concerned too, because - irrespective whether your claimed friend in Taiwan exists or not - you are the sort of guys, who envy the sex life of gays and constantly travel to Bangkok to meet lady-boys, shemales and slutty prostitutes (even if your are eventually married). Not to forget that gal that you shagged the other night, after you went to that straight club and booked with her into the budget hotel, while your wife was doing house cores and taking charge of your kids. No way, this would be in any sense hypocrite, nah... Yes, but this doesn't endanger society, I am sure and all the ladies walking the paths at Geylang isn't bad for society either, in particular when your 11 year old sons pass by after their tuition class at 6pm. Maybe we should crawl back and criminalise sex with prostitutes in Singapore again to safeguard society from all ills.

And all the countries which abolished such discriminatory laws went straight down in decline. Oh, sure, so many examples. Oh, you didn't know that other Asian countries such as Thailand, Vietnam, China, Nepal had already decriminalised gay sex?

We are back to the Romans, Greeks and Persians, Sodom and Gomorrah...

Oh, but Stanley, I am actually more concerned about your mental state.

Maybe you can create a self help group for concerned straight men, there you can discuss all your fears on the growing LGBT minority population and probably the minimal effect on your personal life and society. Maybe you confuse decriminalising gay sex from marriage between two men or women, but that would be a great follow up topic for your self help group...

Why can't these homophobe or religious people leave us alone? it's the homophobe who put us in the limelight by making so many comments and petition. When we said repeal 377A so that people can stop discriminate us, they said we are encouraging gay. I don't understand from where they see we are encouraging or promoting gay after repealing the law. There are some people even better who said "We don’t discriminate but we also don't encouraging gay lifestyle" dafug is gay lifesytle? they think they are open-minded but in fact they are the worst who stereotype gay.

They are various reasons why different group says different things to ensure 377A stays. Majority of them dont even know what 377A is..they just follow because "people say" it allows gay sex gay marriage and all other fucked up ideas without checking the truth

 

Another reason is : 377A is an easy target for people to protest. To the Christian and Muslim, God ask us to love our neighbour, we cannot obey sorry, coz we hate some of them, God ask us to donate to the poor, we cannot obey coz  we claim we don't have 2 dollars, God ask us don't be greedy, we cannot obey because we go buffet we eat and waste food like no tomorrow. God asked us not to steal, we cant obey because we steal time at work surfing internet and gossip. BUT to bash gay WE ALL CAN..only use mouth and click click internet petition. SO lets do it and do God a favor(THEY THINK God need them to do a favor)

 

377A also become a successful plot by the government to smokescreen HDB saga via Lawrence Wong. Who talks about HDB anymore.nobody. Suddenly Singaporean feel sooooo happy that Minister Shamugam says 377A depends on Singaporean. Yea!!!! finally Singaporean can have a voice...so happy lets go sign petition and bash gays online. Anyone who have 1 cm of brain juice will know that it needs more than a petition and bitching to keep or repeal 377A. Signing petition is to make ourselves shiok..thinking we have..power..Now Minister say..it vested on Parliament. So we suddenly lose all power again...

 

Abortion which is legal in Singapore is never contested...where is the religious group? Casino - i did not see religious group protesting, CPF i do not see religious group say a thing..only bitch quietly....why? because we all know bitch openly protest openly will go jail..so LETS PROTEST SOMETHING that do not send us to jail..ie 377A repeal

 

Whatever the reason is, i think we gay try our best to be a good citizen, honor our parents, be a good neighbour, blah blah blah. 377A will not go away by us bitching back like the majority.

If you have faith/religion (like me) you may have slightly different kind of struggle. But lets not give up hope that Singapore will be restored to a good nation as intended by our fore fathers.

And two men kissing in a movie, oh no, your kids could think it's normal and your sons will constantly kiss you or might get all sorts of emotional distress and in the worst they will turn gay. It's already too much that those Indian workers always walk hand in hand in Singapore. That's why you would never go shopping at Mustafa, too dangerous and a bad example to your kids too.

The whole world will tumble down once 377A is abolished. Better don't go to Toy's R US because they might sell a barbie doll with big tits and sexy blond hair. And you know what, what happens if they start selling the Ernie and Bert same sex couple there. Your kids could get it all wrong...

And all the countries which abolished such discriminatory laws went straight down in decline. Oh, sure, so many examples. Oh, you didn't know that other Asian countries such as Thailand, Vietnam, China, Nepal had already decriminalised gay sex?

We are back to the Romans, Greeks and Persians, Sodom and Gomorrah...

Oh, but Stanley, I am actually more concerned about your mental state.

Maybe you can create a self help group for concerned straight men, there you can discuss all your fears on the growing LGBT minority population and probably the minimal effect on your personal life and society. Maybe you confuse decriminalising gay sex from marriage between two men or women, but that would be a great follow up topic for your self help group...

1) The characters in the video is simplified chinese. I believe the clip originates from China rather than Taiwan.

 

2) From what I have read, the marriage equality movement (婚姻平权), is to give same sex couples the same legal protection that the heterosexual couple enjoy. For example, in times of medical emergency, only patient's family can sign the consent for medical treatment. It is not about repealing 377A, please be clear about the subject.

 

3) It is better for the young ones to be aware of sex education from young rather than getting information from dubious sources or "dont ask, dont tell" policy. Besides, isnt protection (safe sex) better than cure (after one contract STDs)? 

 

4) It was the promise of the incumbent president to push for same-sex marriage during her campaign. Many LGBTs were disappointed with her as she did not deliver her promise to her LGBT when she got elected into the office. Besides, like you pointed out LGBT are the minorities, why do the potential office holders are pandering for their votes? Unless you understand the political climate in Taiwan, please dont overgeneralise from a 3rd party perspective.

SINGAPORE - The National Council of Churches of Singapore (NCCS) said in a statement on Thursday (Sept 13) that it does not support the repeal of Section 377A of the Penal Code, adding that it believes "that the homosexual lifestyle is not only harmful for individuals, but also for families and society as a whole".

 

Although not enforced, Section 377A criminalises sex between men.

 

The council, which represents about 200 churches, said it agrees with the 2014 ruling of Singapore's apex court that Section 377A is constitutional and "supports the Government's decision to retain it". The statement goes on to say that the bible "clearly and categorically prohibits homosexual behaviour because it is a perversion of the way in which God has ordered human sexual relationships".

 

"The repeal of Section 377A would result in the normalisation and promotion of this lifestyle, which in turn would lead to undesirable moral and social consequences, a slippery slope as seen in some countries taking this step."

 

The Straits Times reported this week that a disc jockey has filed a court challenge against Section 377A in the Singapore High Court, days after India's Supreme Court struck down a similar law. That decision sparked a renewed debate on the legislation here, with camps on both sides launching petitions either to keep the law or repeal it. A recent survey by Ipsos Public Affairs, an independent market research company, found that 55 per cent of the people in Singapore support Section 377A, while 12 per cent said they opposed it.

 

A legal challenge against Section 377A failed in 2014, when the highest court in Singapore rejected that the provision was unconstitutional. At the time, gay couple Gary Lim and Kenneth Chee, as well as Mr Tan Eng Hong had argued that the provision was discriminatory.

 

NCCS said in its statement: "Above all, the council urges Christians to pray that God will protect the institutions of marriage and family because they are indispensable for the well being of the future generation and the flourishing of our society."

 

The Alliance of the Pentecostal-Charismatic Churches of Singapore, which has about 50 churches, said in a statement 377A must remain. 

 

It said while many cosmopolitan cities have prided themselves on their quick adaptation of popular views and culture, “Singapore is a nation that remains unique in its strong preservation of family values – including its view on marriage as a union between a man and a woman”.

 

Its chairman Reverend Dominic Yeo added that families form the fabric of Singapore’s society and that constitutions and laws have been established to guard the sanctity of marriage and to build the family unit. 

 

He said: “When viewed in relation to Sections 375 through 377C, Section 377A serves a broader purpose of setting a moral position with regard to sexual activities and relationships, and in turn strengthen the social fabric of society. 

 

“A repeal of Section 377A on the basis of it being outdated and passé removes from consideration the reason for its genesis. 

 

“The repeal of Section 377A is not without wider consequences, for it brings to question the legitimacy and morality of every act the Penal Code currently deems as an offence.”

 

Rev Yeo added: “While our position may be viewed as ‘conservative’ or ‘outdated’, the church remains committed to upholding and promoting traditional family values that are the building blocks of our nation.”

 

A petition to repeal the law has amassed almost 37.500 signatures since it was launched on Sept 9. 

 

A petition to keep 337A has gathered more than 99,300 signatures since it was launched on Sept 8.

'The funny thing is that so many gay men have grown so accustomed to the implicit homophobia prevalent in Singapore that they don’t even recognise the ramifications this antiquated law has on their lives.

 

‘Don’t ask don’t tell’ policy at home? Can’t be helped, Asian parents.

 

Got called a sissy in school? Just man up and don’t let bullies get to you.

 

Need to hide your sexuality at work? Aiya sexual orientation is personal no need to broadcast to the whole world.

 

Can’t get married or have kids? Hahaha gave this fantasy up a long time ago.

 

Maybe it’s political apathy. Or maybe it’s just low expectations. But the thing about Singaporeans is that we are very good at making do with what we have.

 

We’ve become so used to the way the LGBTQ+ community is treated in Singapore that we don’t question why things are the way they are. Why are so many parents ashamed of their queer children? Why does being effeminate make one a natural target for bullies? Why does getting married or having kids seem like such a faraway fantasy?

 

In short, growing up with Section 377A has made Singaporeans incapable of imagining a better, more inclusive Singapore.
