Point Middle Finger, Is It Illegal?

How many of you have showed the middle finger and mouthed "fuck you" to unprofessional service providers who also insisted on having a condescending rude attitude.

I admit I've done that to a hawker, a bus driver, a hairdresser, a doctor and even a rude, busybody neighbor and relative, over the span of my life lol.

Is that really illegal to do so in such circumstances?

It's perfectly fine for me!

Because I do it most of the times too when im exceptionally pissed with the public.

Especially Service Providers of course!

Not illegal, I guess.

Unless they want to take further actions.

But I don't think they would.

Based on the fact that they know they are wrong (presumably). They wont fight back too.

While it is NOT illegal, ie, not covered under the Penal Code as an offence worthy of a record (fine and/or jail term and/or caning), the recipient can choose to take you to task by lodging a police report and/or a magistrate's complaint.  And take it further from there, if you are wealthy enough or famous enough for him/her/them to do so.  By lodging a report and a follow-up complaint as already enough trouble, so why bother to be so crude in the first place.  

 

I believe most service providers will just ignore you if you flip the bird at them.  I would.  And it is by far better to chill your temper and seek recourse in other forms (boycotts, complaint letters, etc).  Working up the blood pressure is also bad for your health, "Guest".

If your middle finger is interpreted as a figure for the genitals, it may be construed as an offence, after all your intention was to get back or "hit back " at the person causing an offence to you , whereas the offence by the opposite party may be omission of "manners" or inadequecy of service " which is qualitative in nature, yours was an action or behaviour which can be seen by the opposite party, any one around him or her can act as witness seeing your aggressive behaviour, your action can be captured on CCTV and presented as evidence in a lawsuit, the mere exclusion of "service " on their part cannot be captured on CCTV and subjected to lengthy questioning,

 

Pointing a middle finger at someone is as good as shouting " fuck You " to that person, not only is that action obscene it is also threatening, people have been hauled to court and charged and ever been fined or worse , if the other party has the money and time to engage a lawyer after making a police report which is a recorded statement sweared on oath , you will be in trouble , it is waste of time and money to appear in court, and you may have to pay cost for the other party.

 

Some people might say , pointing a middle finger is a continuation of immature behaviour from childhood, teengage and into adulthood if you persisits to do the middle finger into your adult life.'

 

Want to get back at poor service provider, and make them have a miserable day and make them fear for a loss of their employment , make them have sleepless nights for having to worry about losing their job for treating you rudely, and denying you your sonsumer rights.

 

Go like this:

 

1) tell them in the face, in a calm non agrressive manner, that you are unhappy because their service is not up to standard , not up to your expectation. You are going to complaint

 

2) Give them a chance to make it up to you, tell them what you wnat from them, expect form them , as you are paying for it .

 

3) If they do not relent, or show contrition or apologise to you.

 

4) tell them you have left your handphone voice recording on throughout the fiasco, and also say your friend also have used his handphone to record the whole conversation in video mode while he was tanding nearby , unawares to the sales people. Always quote youtueb, stomp and social media,

 

i can guarantee you, either the store supersisor will start suudenly stop everything he is doing  and start to apologise for poor service, or will start to make urgent , frantic phone calls for higher ups to ask for help or make persmissions to make concessions to make it up to you

 

All these while , you remain calm. give them a stern face, but with a false ,and forced smile,

 

this takes more balls and courage and confidence, than pointing a middle finger at somebody, and casuing you to look like Ah Beng and then get in trouble with the law.

 

If everything cannot be settled in the store, just tell them you will write in to their HQ, write in to their HR manager, write to Newspaper, write to consumer protection Singapore, write in to Channel News asia.

 

When you step out of the store after saying all these, the store workers /service providers will continue to feel the sting, and have a lousy day worrying while working, and you will have a  big smile on your face for spoiling their day, cannot eat cannot sleep LOL

 

Even if you have not used the phone to record conversations, even if you do not have a friend to record the whole episode in video, even if you decide it is too much trouble to write ll those letters of complaint with legitimate grievances to all those I mentioned , they will not know what are the cards you are holding.

 

And the effect last longer on them then just pointing a middle finger at them . LOL

Why do you need to make such gesture??

Doing so only says you don't have a point, and you retreat by making that gesture.

In.extreme cases, we will refer that person to our company's legal team to take possible action.

Er, unless it's a magistrates complaint, even the police will not do anything besides taking down a statement if a police report is made right?

Flicking the middle finger reduced my blood pressure all the time in those circumstances. Otherwise two slaps or a kick to the groin would have landed me in more trouble.

I haven't seen the middle finger being employed for the longest time now..

The general decency of the state must have improved..

While other sophisticated crimes like religious and charity scams and crimes committed by teachers and civil servants have increased. Fantastic.

Telling these people off doesn't work when they insisted on having bad attitude - obviously they have some personal issues. Some of them can be so incorrigible and unreasonable that they twist facts around to blame you for their bad attitude and issues. Like some ugly stupid country bumpkin fat gal from malaysia or suakoo acting gal from china. I have nothing against FT but many of them came with attitudes and baggages that leaves a lot to be desired!

I will also act a bit more to frame/sabo them putting in an elaborate performance, roping in extras from bystanders beforehand to act as calefare plain clothes police, CASE director or CEO, IMH psychiatrist, social woker and case manager to pretend to threaten to testify in court or haul their asses up to be institutionalized for aggravating "ball-less" behaviour like mine in public.

I most frequently flick it when I'm trying to cut lanes while driving, and the other driver suddenly speeds up to prevent me from doing so. I will eventually cut in front of him anyway and flick it so he can see it through the back windshield.

Ok just be sure you don't flick with both gands with just your dick on tbe steerjng wheel... otherwise your flickee will have the last laugh when you crash and burn right in front of him after having your last flicking moment

 LOL, if you want to get back at people, do it with more class, drive a bigger or more powerful engined car than the other party and blow dust in front of their windshield

 

But then this kind of one upmanship , would only escalate and escalate until either,

 

1) Both parties get out of car and exchange vulagarities and then physical altercation.

 

2) Either one parties lose control of their cars, and get into serious accident, end result, police case, media scrutiny, sleepless nights , court case, running from media photographers, shielding with umbrella, sunglasses and newspaper, and appearing front page on wanbao, shinmin, The new paper , making SPH prosper from selling news about you and your rash act.

 

3) Causing anguish to your loved ones, when the above 2) happens.

 

 

 

Remember , this case of rude and rash Honda Civic case in Petir Road, before the youtube videos and stomp videos, he act yaya papaya when he was alone with the female driver which he claimed cut abruptly into his lane, and the he did all those cut infront then brake suddenly behaviour, and then got out of his car and walk "stalkingly " to the lone female drivers car and showed some finger actions.

 

Later when he was exposed , car number exposed, his status as a tertiary student exposed on newspaper and social media, he could not take the pressure, he said his bad behaviour had caused his mother severe grief and shame and emabarrassment, tha the mother dare not step out of the house.

It was reported he went down on his knees to apologise to the womanhe threatened, through the media, and begged for the offending video to be erased and disappear from cyberspace, ask the woman not to take him to court as it would destroy his family.

 

I think he was more worried if the tertiary institution would terminate his studies instead more so then he was trully remorseful. Of course, he said in court he said he was remorseful for a lighter sentence. But Singapore is full of these, fatso or normal guys who are testosterone driven and want to show off they are man , 'real man' by bullying a lone female driver . Haha once exposed in media he became meek as a mouse, for now.

I do not think whether it is illegal or not, but rather, the need to do it?

Does pointing the middle finger, getting all worked up helps to solve the problem?

 

I have mellowed with age. When I looked back at my fiery temper during my younger days, I find myself rather silly. Keep calm and things can be resolved better.

 

Anyway, I do think there are cases of people being charged for pointing the middle finger? So, ultimately, what's the point of pointing if it only gets yourself in trouble?

You may think all service providers have to swallow your nonsense, even who's in the wrong, but there are limits a person can accept and tolerant, and they may not be afraid of you to bring you to task, even you think they are at your mercy.

 

If you feel that you are not fairly treated, there are proper avenues to address your displeasure

 

So  please don't think you can go around trying your luck, kicking sick cats, for they can turn around and claw you back in your face like a tiger

My best experience so far is running errant while ruahing to appointment and sole customer service fat gal in the shop threw her attitude with her weight around, ignored my question then denied service to me after I castigated her for her sloppy and DUSTY attitude. Slammed her boss's photocopier down HARD with her trotters and challenged me to complain to CASE when everyone knows how futile and time wasting the effort is going to be if she only damaged her boss's equipment and none of my properties. Shame on the shop owner and serve him/her right for engaging such stupid and uncouth cheap labour when paying slightly more for an educated local undergraduate to fill temp position like this would have ensured a better experience for everyone.

It was the tai tais and school girls before me who were commandeering her around and asking incessant questions, yet I received the rude treatment for nicely asking her how long will it take for the lady before me to download her entire smartphone photo folder into her pc. Maybe I should start acting rudely like thise tai tais so I will get better service and atttention.

Well, if the judge do have a better eyesight and see who's really fat and oily face as compared to her, maybe he will know why everyone is rude to you !

I always point my middle finger in Australia to white drivers who horn at me to scare me just simply because I am an Asian Chinese walking alone on the pedestrian pathway .......

Well I sometimes have anger issues when i get stuck with family issues. I ever told an irritating fat school gal sales staff to fuck off with that fugly face, big teeth et al before when she followed me around like a bunny in the shop, too uncomfortably physically close, and ever eager to engage in a welcoming serving chat. And I still think unprofessionalism sucks as much as mindlessly doing the job while satifying that nymphomanic 'urge' so they totally deserved it.

I asked to speak to her manager but apparently she ignored my request cos she was alone at the shop (I guess). Was in a rush and didn't want to waste time explaining and listening to his stupid explanations seeing that he employed such cheap labour to cut costs.

(1) coupled with an intent to cause harassment alarm or distress to another person (S13A Miscellaneous Offences (Public Order and Nuisance) Act), OR

(2) was within the hearing or sight of any person likely to be caused harassment, alarm or distress (S13B MO), OR

(3) coupled with an intent (S13C MO, S351 Penal Code - Assault), or a knowledge that it is likely (S351 Penal Code - Assault), to cause the other person to believe that immediate unlawful violence will be used against him, OR

(4) used towards a person likely to believe immediate unlawful violence will be used against him (S13C MO), OR

(5) so extensive as to cause annoyance to the public or persons who may have occasion to use any public right (S268 Penal Code - Public Nuisance), OR

Talk so much, see how you deal with it when you are in a rush for appointment and a nondescript fat country bumpkim gal from malaysia crops up from nowhere and thwarts your plans with her 500kg baggages and 50 years' worth of issues.

 

I was just trying to point out that acting out of anger in some "humiliating" incidents, and bullying someone else by using threatening behaviour or using mddle finger on other people in Singapore can backfire on yourself resulting in having to apologise publicly to party you pointed middle finger to after you are drag into the court room.

er no one seems to be giving an answer to the question.

The short but comprehensive answer is yes flipping the bird is illegal (i.e. sounds in a criminal offence) only if it is:

(1) coupled with an intent to cause harassment alarm or distress to another person (S13A Miscellaneous Offences (Public Order and Nuisance) Act), OR

(2) was within the hearing or sight of any person likely to be caused harassment, alarm or distress (S13B MO), OR

(3) coupled with an intent (S13C MO, S351 Penal Code - Assault), or a knowledge that it is likely (S351 Penal Code - Assault), to cause the other person to believe that immediate unlawful violence will be used against him, OR

(4) used towards a person likely to believe immediate unlawful violence will be used against him (S13C MO), OR

(5) so extensive as to cause annoyance to the public or persons who may have occasion to use any public right (S268 Penal Code - Public Nuisance), OR

(6) coupled with an intent or with reason to believe that flipping the bird would lower the character or credit of the person in the estimation of others (S499 Penal Code - Criminal Defamation) (this would require a 3rd party to see the sign being made).

Wow. Now I am the bully. Thanks. I am speechless. Will be even more speechless from my surprise if she that fat gal et al can and will afford lawyers to defend their palsy and flimsy positions of an offence being turned into a laughable defence. Lol!

The legalese is the most concise way to state the precise meaning of the law. I have provided the relevant sections in statues. A comparison with the statue would reveal I have endeavoured to keep my summary already very lean.

 

I should also state that flipping the bird is only illegal if any one (or more) of the 6 conditions are met. If not, then it is legal.
