Not a lawyer so I can only state what I think...

Penal code 377A prohibits any form of male-to-male sex - Imprisonment up to 2 years

Penal code 376A prohibits sex with minor (below 16 years old), with or without consent - Imprisonment up to 10 years, and/or fine, in the case of below 14, Imprisonment up to 20 years and/or fine with or without caning.

376A concerns sexual penetration of "the vagina, anus or mouth, as the case may be", i.e. that the it can be male or female that receives the penetration.

So I think the legal age of consent in Singapore is definitely 16 years old for both male and female.

So typically when gay sex issue goes to court, I think 376A is applied on those below 16, while 377A is applied on those above 16, though law minister would say they don't prosecute using 377A (hence there's no need to abolish it).

Having said that, we also need a law expert to point out all the past cases regarding gay sex, because judges will rely on past cases to make decision...

1. A guy with legal training briefly explained the following to me:

a. In Singapore, the Age of Majority is 21 years old. Below that he is a "minor".

b. Under Penal Code (ie Criminal Law), Section 87, a person above the age of 18, can give consent to be harmed provided it does not cause death or grievous hurt. The law clearly states 18yo as the age of consent for "general exception" to Penal Code offences. Therefore below 18yo, his consent may not necessarily be a valid defence for penal code law as it explicitly mentions 18yo as the consent.

Singapore Penal Code

Chapter IV. General Exceptions

Act not intended and not known to be likely to cause death or grievous hurt, done by consent

87. Nothing, which is not intended to cause death or grievous hurt, and which is not known by the doer to be likely to cause death or grievous hurt, is an offence by reason of any harm which it may cause, or be intended by the doer to cause, to any person above 18 years of age, who has given consent, whether express or implied, to suffer that harm; or by reason of any harm which it may be known by the doer to be likely to cause to any such person who has consented to take the risk of that harm.

Illustration

A and Z agree to fence with each other for amusement. This agreement implies the consent of each to suffer any harm which, in the course of such fencing, may be caused without foul play; and if A, while playing fairly, hurts Z, A commits no offence.

2. At BlowingWind, we use 18yo as a cut off age. This safe guard our readers and the mods.

I believe the Singapore saunas use 18yo for probably the same reason too.

3. Of course if the police wants to use 377A, both will still get it.

But our Government has given assurance 377A will NOT be pro-actively enforced.

4. My advice to everyone, stay clear of anyone under 18yo to be safe.

Whether the underage guy enjoyed the sex or not does not even begin to matter. Even if the sex was consensual, in the eyes of the law here it is still sexual exploitation as the underaged are considered to be vulnerable and unable to make fully informed decisions on their own, hence the need for legal protection.

No doubt the law may have been broken thousands of times behind closed doors, but should the deed come to light, there is no way the older man can get himself out of trouble here in Sg. Period.

There is no legal age for male same-sex activity because all male same-sex activity is a criminal offense under Penal Code section 377A. There is no official age of consent for males to agree to have sex with females.

Actually, it's not quite that simple. The creation of the British Empire - one of the most powerful but shortest-lived empires in history of the world - was driven by mercantile trade, not by religion. By the time colonial territories were established and had to be administered, all kinds of laws came into existence. My guess is that the British did not wish to deal with same-sex relationships in these new 'societies' (too complicated!) so they imposed heavy anti-sodomy laws to make it less likely to happen. They probably also feared scandalous sexual incidents occurring between members of different races - too embarrassing!

At some point they must have realised that some of their own people (us English and other Europeans) were beginning to look lustfully on peachy young local boys. (Just as the majority of ang mohs were looking lustfully at shapely young local girls). The British law-makers probably wanted to frighten other Brits into avoiding naughty behaviour and bringing the colonial administration into contempt.
