The men, aged between 19 and 60, were picked up at around 8pm on Nov 28 in a surprise raid involving Kuala Lumpur police, Kuala Lumpur City Hall (DBKL) and the Federal Territories Islamic Religious Department (Jawi). Of those detained, 17 were identified as civil servants, including a surgeon, a deputy public prosecutor, an administrative and diplomatic officer (PTD), a teacher and several enforcement officers. Kuala Lumpur deputy police chief Mohd Azani Omar said intelligence and surveillance on the two-storey premises had been conducted for two weeks following public complaints. “Investigations revealed that immoral activities were allegedly taking place on the premises involving male patrons,” he said at the scene. The centre, which operated under the guise of a health and wellness facility equipped with a gym, sauna, spa, swimming pool and designated rest areas catering specifically for men, is believed to have been running for the past eight months, DCP Azani said. “Customers were charged a RM10 (S$3.10) lifetime registration fee and RM35 per visit. “We believe the operators promoted the centre through social media, where patrons would connect and mingle,” he said. The arrests included locals as well as individuals from South Korea, Indonesia, Germany and China. DCP Azani said police are investigating the case under Section 387B of the Penal Code for offences related to unnatural sexual acts. Jawi also detained 80 Muslim men under Section 29 of the Syariah Criminal Offences (Federal Territories) Act for indecent behaviour in a public place. The centre reportedly operated daily from 5pm until late at night, targeting patrons seeking to unwind after work. All detainees were taken to the Dang Wangi police headquarters for further action. Checks revealed that the venue had been widely discussed online among groups seeking social connections, with some visitors claiming the centre offered “special services”. The Justice for Sisters - an LGBTIQ and gender-diverse human rights group in Malaysia - condemned the raid. The group’s spokesperson said on Nov 29 that the community has already been unfairly discriminated against, and the raid, coupled with sensational media coverage, would deter those involved from seeking support and undermine efforts to end HIV and uphold human rights. “The media were also invited to participate in the raid, resulting in further violation of the privacy of the detainees,” said the spokesperson. “It is important for the police to discern prejudicial elements in public complaints, given the alarming levels of discrimination against LGBTQ people in Malaysia, Quote

Remember that the constitutions of several of ASEAN's non-Muslim neighbors are beginning to recognize gay marriage. Sauna is merely a form of entertainment and nothing more to the eyes of authority. More importantly, Singapore has always wanted to be seen as an important part to the Western worlds, where every individual is being respected and gay sex is not a crime. However, the authorities will take action, whether it be in a hotel or another location, if there is a suspicion that drugs and other vices, not about nudity, are involved, particularly in big numbers. Already so many patron complain about "stuff" so they sent out staff time to time to patrol their own establishment. Because there is no such thing as "gay spa" in singapore, gay friendly spa is the word. And if the police (imagine in disguised) does a spot check and you are in some kind of action not prohibited by the rules of the spa establishment, what do you think may happen? Sodomy is not punishable under this Federal Syariah Crimes Act ! Shariah Courts have no authority to punish anyone under Shariah Laws if the Crime is already covered in the Federal Penal Code. "Unnatural Sex aka Carnal intercourse" is covered in 377A/B of the Malaysian Penal Code, therefore Shariah courts have no authority to charge anyone under this! Simple as that! In this case, if the Prosecution does not charge any person for 377A, the case is also closed for any Shariah courts (in fact the case was always closed for Shariah). I can only recommend anyone affected to get a lawyer and object to any Shariah court proceedings. If the police didn't have strong case under secular law, I believe they would have even weaker case under shariah law as shariah law requires 4 credible witnesses. The police should be well aware of how their country's laws work yet they proceeded with this raid. To me it looks like for show, wayang only. Quote

Minister in the Prime Minister's Department (Religious Affairs), Datuk Dr Mohd Na'im Mokhtar, said the suspects were summoned to the Jawi Enforcement Division office to record their statements to assist in the investigation. He said the process was carried out under Section 59 of the Syariah Criminal Procedures (Federal Territories) Act 1997 (Act 560). "Jawi has completed its investigations into the suspected individuals under Section 25 (for sodomy), Section 29 (indecent act in public places) and Section 47 (attempt) of the Federal Territories Syariah Criminal Offences Act 1997 (Act 559),” he said in a statement. He said the suspects appeared before the Investigation Branch of the Jawi Enforcement Division and cooperated fully during the statement-recording session. "Next, statements from witnesses will be recorded in the near future to gather further information and evidence to support the investigation,” he said. Na’im urged all parties not to downplay issues of moral decay, warning that if left unchecked, such behaviour could erode the identity of future generations and damage the nation’s dignity. "Religious propagation institutions must intensify efforts to convey a clear and proper understanding of Islam to the community,” he said. Last Friday, 17 civil servants were among 208 individuals arrested in the raid, which also involved the seizure of condoms and several equipment believed to be used for immoral purposes.- => Once again the Religious authorities in Malaysia are overstepping on the authority on 377A. As Shariah Courts have no authority to charge anyone on sodomy, the interrogation under the pretext of Section 59 is also illegal. You have no obligation to give any evidence on sodomy to JAWI as acting on this under Shariah Law is simply unconstitutional. This seems to hint also quite clearly what agency is behind the whole complaint. Quote

If you are acquitted or not charged for any crime then there is no basis for any action by the Malaysian Education Ministry. You can't be reprimanded for anything that you are not charged in a criminal court. Those officers from the Education Ministry should also get a lawyer to defend them. Further, in all cases the lawyer should also request whether there was any valid search warrant for the premises. It appears very often that the police didn't have any valid search warrant to undertake any raid. Hopefully, there are some volunteers who can help those impacted financially or you all who are impacted seek one lawyer acting for you all together. Quote
