There is no public complaint, probably the owner refused to pay the local police coffee money and other fringe benefits so kena targeted...sauna owners are getting increasingly tired and frustrated over the year, evident by the closure of a highly popular sauna since years back

I also highly doubt there is public complaint about the sauna. since it is located at the far end secluded area and make no noise out from the premise and no signage existed. The public passerby would not know there is such place existed unless they are being told. Most likely this raid is resulted of sabotage.

 

Also, one search in google for "gay sauna" , otot2 is the top link in the feed. Won't be surprised this forum could also be one of the triggering factor for the police to conduct the raid.

okay can... you are sure its not, yet use the word "probably" after that. Its stated in the article its due to public complaint black and white. Just checked Kakiku Sauna in google. They have closed since yesterday.

 

Kakiku is the 2nd most popular men sauna right after otot2. The owner smart enough to close the business temporarily.

I also saw the news there is one sauna in penang also got raided yesterday night but only 11 pax got detained.

 

I think they are trying to raid every men-only sauna in town now.

I m not as long as you in SEA but Chow Kit has a monorail steysen plus it was known because of the huge Trade Fair Center behind PWTC Lrt steysen  where also the long time government party held their yearly Congress. Was also famous for food. Maybe you just don't know KL. At same place as the sauna were various LGBT organisations and help groups and also previously the free HIV testing center that later moved to Sentul. 

 

The sauna must be operating there since 1997 or so...

Have to see if in the times of 2025 the parliament seriously intends to implement stricter laws.

Reading the part from the religious authority it seems that these are pushing for harsher enforcement...

 

I assume the foreigners received a warning letter.

Errr weird weird. Whats wrong here though? Unlike in otot2 there is a secret dark level and found condom/lubes. But from here it just seems like any regular Sauna (which should only mean male only sauna). People be chilling in sauna not doing funny thing but still get caught?

In various judgments the Malaysian Federal Court has decided that the States and Territories (KL) in Malaysia cannot enact criminal laws under Shariah which are already covered by the Federal Penal Code (Criminal Code = Malaysian Penal Code (Act 574)). Same applies to the Syariah Criminal Offences (Federal Territories) Act 1997: 

 

If anyone is going to be charged by a Shariah Court defend yourself, get a lawyer and oppose any charges by any State / KL religious authority/ Shariah court. This applies (amongst others) to the following: 

Shariah imposed punishments rooted in Islam for offenses that included sodomy (unnatural sex/ carnal intercourse), sexual harassment, incest, cross-dressing. 

(in the article below is a list of what Shariah Courts cannot issue punishments)

 

The Malaysia law position is clear: 

State or territory religious authorities have no right to issue any punishment for such crimes, which are already covered in the Federal Penal Code or other Federal criminal laws. 

 

I include also "indecent behaviour" as this is also covered by the Federal Malaysian Criminal Law. 

 

If the Federal authorities (police/ criminal courts) don't charge you on Section 377A, then local Shariah Courts have no authority to charge you here on a religious basis. 

 

What the Malaysian Minister for Islamic Religious Affairs is talking would constitute such unconstitutional action by Shariah Courts. These Shariah courts have no authority to go against you for "sodomy" or "attempted sodomy". 

 

Quote: Mokhtar, the minister in charge of Islamic Religious Affairs, said the acts in the spa are “a very serious moral offence…not only from the legal perspective but also from the religious perspective, it is unacceptable”, Bernama reported today. He added that Shariah laws could be applied to this case as attempts to commit sodomy.

I try to enlighten you: 

 

The police might still investigate and find evidence against you. The police can find other evidence to charge you on a different basis also. Police investigations must not stop overnight... 

The arrest might cover various different sections of the Penal Code, even if one drops another might apply. 

The Police says they currently can't be charged under 377A or prostitution but still can be charged for something else. 

 

If you are arrested for some crime, then as long as you are under investigation, the bail will remain. Either the investigation will be closed with no charges or you are acquitted by court, then the bail will terminate.

Bail is only applicable when someone is being investigated for an offence with a legal basis. In this case, the police later admitted there was no victim and no chargeable offence, which is why the court refused the remand request and ordered the men released. Thus, they are freed, not on bail. No charge, therefore no bail needed.
