SINGAPORE: A 29-year-old man was jailed for two years on Wednesday (Aug 1) for having sex with a man without telling him that he ran the risk of contracting HIV infection from him.

The man, who cannot be named due to a gag order, had been previously diagnosed with HIV infection - a virus which attacks the immune system. 

There is currently no cure for HIV infection, only treatment that suppresses the replication of the virus, delaying its spread and the onset of AIDS. Court documents did not reveal when the accused received the diagnosis.

After testing positive for the human immunodeficiency virus, he was counselled by an officer from the National Public Health Unit, Ms Fiona Lee.

Ms Lee testified that she had advised the accused to inform his sex partners of his HIV-positive status if he wanted to engage in any sexual activity, so that his partners would be aware of the risk of HIV infection.

Despite this, the accused went on to have sex with a man on five or six occasions between 2012 and 2013 at his own home.

The accused did not inform the victim, whom he met online, about the risk of contracting HIV virus.

The victim found out that his partner was HIV-positive only in 2015, after the investigating officer informed him about it, and testified that he would not have had sex with the accused if he had known about his HIV status.

The prosecution asked for a sentence of at least 24 months' jail.

"While advancements in the treatment of HIV infection via anti-retroviral therapy mean that it is no longer the death sentence it used to be, HIV infection is an incurable, serious and life-changing disease, which still could result in fatality," said the prosecution.

District Judge Chay Yuen Fatt sentenced the man to 24 months' jail.

The man, who was represented by defence lawyers Remy Choo and Priscilla Chia, appealed against his conviction and sentence.

He could have been jailed for up to 10 years and fined up to S$50,000.

I can't imagine having hiv and have to take medicine for the rest of life. Not forgetting many unforeseen illness to worsen due to a poorer immune system. HIV people have needs too, no? Isn't it unreasonable and unrealistic to demand that they abstain from sex?

How about their sexual needs?

What's more important is that they practise safe sex each and every time and inform their partners beforehand.

Responsible sexual behaviour - and this applies to both neg and poz folks - goes a far longer way instead.

For me, I don't have sex with active strangers so I'm relatively 90% safe. I may sound harsh, but you never know when you could be the next hiv victim when sleeping around casually with someone, who might have slept with someone's someone having hiv without checking clear of window period etc

There's always the option for poz on poz sex, no? Why do they have to abstain, how can they? We're all still human beings. And who comes into a thread about HIV and goes saying stuff like "Prevention is better than cure." It says a lot about you.

 

The point here is treatment as prevention. It's next to impossible to catch the virus when he's on meds and has his viral load on undetectable levels. Not saying anyone should just go around sleeping with poz folks who are actually monitoring their condition but at least be informed before passing comments that are fearmongering.

There are different strains of HIV. So even if it's poz on poz, please still use protection as it might blow up to be a superinfection. Some strains are drug resistant as well.

I feel at the very least if sex is on the table, please be open even if it's undetectable load. The other party deserve to know. Who knows when was the last test done and maybe someone skip the medication after that test?

@kratos I know, safe sex regardless of HIV status. And blips can occur even if there's due diligence on ART so the risk is always present. I mentioned poz on poz cause it's an easier option considering how there's already basic mutual understanding.

 

No matter how some try to sugarcoat things (like how a guest above went "Not discriminating them but..."), the stigma on HIV is real. Some folks actually still believe it can be transmitted through sharing a spoon and won't even sit down for a meal with a HIV+ person. What then? Damned if you do, damned if you don't.

 

At the end of the day, I wouldn't be surprised if some of us here have actually slept with a poz, remained negative and never knew the truth.

Sad to read this.

The best way for HIV+ patients is to continue the medication as prescribed by the doctors. Don't skip it.  Sex, there are many alternatives to physical contact without another person.  Go back to the basic of watching porn.  Very soon, the patient will get jaded and lost his sexual appetite altogether.

There are many other diseases you can catch even with condom, including antibiotic-resistant STDs, exotic bacteria that cause necrotic tissues (google Transavia flight) and chronic ailments like Hep C etc. Not just "active strangers": you should stop having sex with anyone. You're missing the point here. The accused is being charged for not informing prior to sex and not for transmitting the disease, nowhere in the article says the victim is HIV+.

Waduge Buddhika Upashantha Fernando, a 38-year-old Singaporean of Sri Lankan descent, is married with three children and lives in a flat in Kim Keat Avenue.

 

The victim was a 28-year-old Malaysian working in Singapore as a cook. He cannot be identified due to a gag order. 

On the day of the assault in November last year, he had been a tenant at the flat for about four months, the court heard.

His usual routine meant that he left the flat at 9am and returned only at 11pm, and he had little interaction with Fernando and his family.

At about 11.30pm on Nov 10 last year, the victim returned to the flat and had a shower. He then went to his room, closing the door and going to bed at about 1am.

About two hours later, Fernando returned home from work. He was on his way out to buy vegetables when he "felt the urge to engage in homosexual activity", court documents said.

He knew that his tenant was sleeping, and entered his room where the victim was asleep in a pair of shorts.

Fernando then knelt on the floor, removed the victim's shorts and performed a sexual act on him.

After about 10 minutes, the victim woke up and realised what was happening. He also felt Fernando rubbing against his shin.

Instinctively, he yelled and kicked at Fernando, who left the room and the flat.

The victim was shocked and did not know how to react. Within the hour, he sent a message to the police hotline asking for assistance.

Fernando pleaded guilty to one charge of sexual assault by penetration.

He’s now a Singaporean and a commoner like most people, so hash sentence after 1 year.  If he is ang mo CEO earning big bucks, then he can plead leniency because he lost his highly paid job due to this case = enough punishment, he showed remorseful, blah blah blah..... then ?!

He's staying in Kim Keat and just before the estate there's a vegetable wholesale market that operates right after midnight.

 

As for the severity of the punishment meted out, it may sound  harsh but what he had committed was nothing less than a rape. It is justice.

Based on the report alone, nowhere did it say that the man was prosecuted under section 377A. What was stated is he was prosecuted under non-consensual sex "between two individuals." The word "individuals" is significant, because it shows that regardless gender, non-consensual sex is a crime. Hence it is safe to say that defendant was not charged using 377A. If he were, the DPP's statement would have been different. 

 

They cannot charge the defendant with 377A since it is clear that one party was non-consensual. Hence if the DPP were to charge with that in court, he will lose the case.

（新加坡23日讯） 已婚工程师半夜闯进男房客房间，趁房客熟睡时替对方口交惹祸，法官斥骂工程师行为令人髮指，判他坐牢6年鞭打3下。

被告瓦杜科（38岁，译音）原籍斯里兰卡，现已是新加坡公民，案发时是一名项目工程师，与妻子和3名孩子住在大巴窑金吉道一带的组屋。

他面对一项控状，指他在去年11月11日凌晨3时至3时30分，在屋里为一名28岁男房客口交。

据案情显示，这名房客来自马来西亚，在新加坡当厨师，案发时在被告家住了4个月。

男房客在案发前一天晚上11点半回家，在冲完凉后在凌晨晚上1点睡著。被告凌晨3时05分回到家，换好衣服打算外出买菜。不过他一时性起，有股要与同性进行性行为的衝动。

他见男房客房门没锁，入房后又看见房客赤裸上半身，仅穿一条蓝色短裤。由于房客当时没穿內裤，双脚有打开著，因此从侧面能看见他的下体。

被告按耐不住慾火，先跪在房客身旁，脱下房客短裤，並为他口交，直到房客下体勃起为止。

性侵行为持续了10分钟，房客被惊醒后感觉下体「湿湿」，还发现被告下体也勃起，在他脚上磨蹭。房客被嚇呆，下意识一脚將被告踢开。

被告之后假装没事，出外买菜，但房客之后报警，他回家时被逮捕。

律师代被告求情时说，被告坦诚婚前有对別的男人有进行同性性行为的衝动，不过在婚后已將慾望抑制下来。

律师透露，被告拥有澳洲一所大学的工程硕士学位，原籍斯里兰卡，于2008年结婚，育有两名分別8岁和6岁的儿子，以及一名3岁女儿。被告一度没工作，去年1月至7月当优步司机，案发时打两份工，早上当工程师，晚上当侍应生。

法官今早下判时，指被告行为令人髮指，要他以后不能犯下同样的罪。

The sentence has nothing to do with him being gay. It has to do with non-consensual sex. Note that the DPP used the term "individuals" not 2 men. Anyway, if your housemate know you are engaging in homosexual act, and reports you, yes, technically you can be charged under 377A for breaking the law. However, like J walking, the police have better things to do than come knocking on your door after you are done with the act. 

 

The thing about law is it has to be black and white. In cases like this, the public prosecutor has to determine which law has been broken. In this case, it is not so much anything that has to do with gay sex, but non-consensual sex. If the public prosecutor were to go after the case as violation of 377A, then the tenant has to be gay, agreed voluntarily to engage in gay sex, and was caught breaking the penal code. More importantly, the sexual orientation of the tenant is not the issue here, but the violation of privacy and non-consensual sex. The same punishment will be given out if the tenant is female, or even if the tenant is a gay male. No means no.

This is 377A:

 

"Any male person who, in public or private, commits, or abets the commission of, or procures or attempts to procure the commission by any male person of, any act of gross indecency with another male person, shall be punished with imprisonment for a term which may extend to 2 years."

 

Where it is vague is the term "gross indecency" which is up for interpretation, but what is clear is that gay sex is a criminal offense between consenting adults. 

 

In the case of the woman giving a bj to a non-consenting male. she can be charged under the same rules. FYI, caning as a punishment is exclusive to male offenders only.
