But there's a high burden of proof for 377, they need to catch them in the act. So it is important that none of them confess to anything. 

 

For the moment I think those who have been arrested might have access to phone. We are already in touch with a couple of them. If you have a friend who has been arrested, please pass the following message: 

 

1. Reach out to a lawyer or activist they know immediately. A few lawyers and activists are also on their way there. We are also trying to find Syariah lawyers.

 

2. If they don't know any lawyer and cannot reach out to anyone there, ask them to pass their IC number and phone number to you, and grant you permission to share with us. Please make sure you don't share their details in the comment; do PM me instead. 

 

3. Tell them to plead NOT GUILTY to anything. 

 

4. Tell them they are not obliged to answer questions like what they are doing there and if they were having sex. Below is a guide on what they can answer and what they shouldn't. 

Individual information (that you can answer to police) such as:

i. Name , address (as per IC, even though you may no longer living there)

ps; if ic address is parent's address, and you have concern, can give your resident address

 

ii. Father's name

iii. How many siblings 

iv. Your education level 

 

The above is also useful for any of you if you are ever in this situation. 

 

5. Ask them to get each others phone numbers so they can stay in touch after they are released. It will help us reach more of them with legal assistance.

 

6. Remind each other they have rights and their rights are being violated by the police and media right now. Ask them to stay calm and support each other. 

 

7. After they are released, they might need legal and mental health support. Ask to reach out please. Here are three contacts:

This is very helpful. 

 

I laud you for your initiative. 

 

Unfortunately, too many feel shame and want to get out of the situation and confess anything. 

 

But it doesn't help them and the community. 

 

The point of "being caught in the act" is correct, which means there must be evidence of anal penetration. 

 

Best is not to talk at all and just give personal data. 

 

For the Malays, under Shariah the religious authorities must have 4 male witnesses to the Act. 

Therefore, I don't think the matters can be prosecuted at any Shariah court. 

 

Boys, stay strong, we all are with you. 

 

Actually, Malaysia might also need a Stonewall event to stop all this repression against the LGBT community. 

 

For sure, there is far more serious crime against which the police should act against.

The media reported that Jawi, the religious authority, took part at the action. This hints to me where the "complaints" came from. 

 

The next General election in Malaysia is only due in 2028, I don't think it's linked to elections. 

 

Probably, certain parts of the majority community in Malaysia simply intend to clamp down on " a certain moral deviation". 

 

But it will fail because of the nature of being gay.

Just checked Kakiku Sauna in google. They have closed since yesterday.

 

Kakiku is the 2nd most popular men sauna right after otot2. The owner smart enough to close the business temporarily.

I also saw the news there is one sauna in penang also got raided yesterday night but only 11 pax got detained.

 

I think they are trying to raid every men-only sauna in town now.

 

Forest 52 has to be highly aware now. I have the strong feeling it will be targeted next.

KUALA LUMPUR, Nov 30 — What started as a high-profile raid on a spa and health centre in Chow Kit here for suspected deviant sexual activities ended with 171 Malaysian men walking free on bail, apparently because no one admitted they were a victim.

I m not as long as you in SEA but Chow Kit has a monorail steysen plus it was known because of the huge Trade Fair Center behind PWTC Lrt steysen  where also the long time government party held their yearly Congress. Was also famous for food. Maybe you just don't know KL. At same place as the sauna were various LGBT organisations and help groups and also previously the free HIV testing center that later moved to Sentul. 

 

The sauna must be operating there since 1997 or so...

That is a good development. 

 

Have to see if in the times of 2025 the parliament seriously intends to implement stricter laws. 

 

 

There was no "victim" gave me a good laugh. 

 

Reading the part from the religious authority it seems that these are pushing for harsher enforcement...

 

I assume the foreigners received a warning letter. 

 

The fact that Deputy Prosecutors, government officials and diplomats were "caught" shouldn't wonder anyone as you find LGBT in all segments of society.

The Malay Mail report makes the raid look legally dubious. Under Malaysian law, offences tied to “vice,” prostitution, or “unnatural acts” generally require a victim or complainant to establish the elements of a crime. Police admitted they could not charge any of the 171 men because no one reported harm, and the court even rejected the remand request for lack of legal basis.

 

This effectively means the mass detention was carried out without evidence that a crime had occurred. In practice, this turns the raid into a form of moral policing rather than lawful enforcement,  detaining people first, searching for a crime later, which runs counter to basic due-process standards.

 

Under Malaysian law, individuals who are arrested or detained without lawful justification have established grounds to bring civil claims, typically under the torts of “false imprisonment” (or “wrongful detention”) or “misfeasance in public office.”  Courts have awarded substantial damages in such cases. 

 

In this case, where authorities themselves declined to press charges due to lack of a victim or credible complaint, detainees may have a credible legal basis to argue that their liberty was unlawfully restricted, particularly since there was no demonstrable offence (ie. the police was unable to prove that a crime took place). If they can document the circumstances (time, conditions of detention, records of arrest / release, any mistreatment), they might successfully pursue a civil suit for false imprisonment or misfeasance.

Errr weird weird. Whats wrong here though? Unlike in otot2 there is a secret dark level and found condom/lubes. But from here it just seems like any regular Sauna (which should only mean male only sauna). People be chilling in sauna not doing funny thing but still get caught?

 

 

I really hope these people have the courage to sue the police and authorities for these raids.

people's lives ruined and reputation in tatters

i doubt these businesses will survive

I don't think a travesty like this is something that we (gay clientele) will forget in a few months

my inclination to visit malaysia has gone down down down, and for sure I will not visit any gay saunas there.

previous visits to otot, kakiku, and maze in JB they will all just become memories

So scary. I was planning to go there last Friday but flooding around my area (Klang) so I have to cancel the plan.  

I am leaving Malaysia for 6months in 2 weeks also. No more fun for me in Malaysia I guess.

 

I can only hope those detained aren't traumatized for long.

Really bad.

Now I will have no more places to visit to relax myself from the daily tiredness 

even though how safe it is, I will never go to these saunas, atleast for the next 1yr or so

Likewise, Going to sauna is not about having sexual fun alone. The sauna and steamroom are the added benefits for us to enjoy to relax. With such tremors like this happening out of the blue, it gives us no confidence in returning to the premise again. 

After all, otot2 has been operating for so many decades, it is time for its closure.

To the Malaysian Malays/ Moslems concerned by the sauna raid or having been arrested. 

 

In various judgments the Malaysian Federal Court has decided that the States and Territories (KL) in Malaysia cannot enact criminal laws under Shariah which are already covered by the Federal Penal Code (Criminal Code = Malaysian Penal Code (Act 574)). Same applies to the Syariah Criminal Offences (Federal Territories) Act 1997: 

 

If anyone is going to be charged by a Shariah Court defend yourself, get a lawyer and oppose any charges by any State / KL religious authority/ Shariah court. This applies (amongst others) to the following: 

Shariah imposed punishments rooted in Islam for offenses that included sodomy (unnatural sex/ carnal intercourse), sexual harassment, incest, cross-dressing. 

(in the article below is a list of what Shariah Courts cannot issue punishments)

 

The Malaysia law position is clear: 

State or territory religious authorities have no right to issue any punishment for such crimes, which are already covered in the Federal Penal Code or other Federal criminal laws. 

 

I include also "indecent behaviour" as this is also covered by the Federal Malaysian Criminal Law. 

 

If the Federal authorities (police/ criminal courts) don't charge you on Section 377A, then local Shariah Courts have no authority to charge you here on a religious basis. 

 

What the Malaysian Minister for Islamic Religious Affairs is talking would constitute such unconstitutional action by Shariah Courts. These Shariah courts have no authority to go against you for "sodomy" or "attempted sodomy". 

 

Quote: Mokhtar, the minister in charge of Islamic Religious Affairs, said the acts in the spa are “a very serious moral offence…not only from the legal perspective but also from the religious perspective, it is unacceptable”, Bernama reported today. He added that Shariah laws could be applied to this case as attempts to commit sodomy.

I try to enlighten you: 

 

The police might still investigate and find evidence against you. The police can find other evidence to charge you on a different basis also. Police investigations must not stop overnight... 

The arrest might cover various different sections of the Penal Code, even if one drops another might apply. 

The Police says they currently can't be charged under 377A or prostitution but still can be charged for something else. 

 

If you are arrested for some crime, then as long as you are under investigation, the bail will remain. Either the investigation will be closed with no charges or you are acquitted by court, then the bail will terminate.

Bail is only applicable when someone is being investigated for an offence with a legal basis. In this case, the police later admitted there was no victim and no chargeable offence, which is why the court refused the remand request and ordered the men released. Thus, they are freed, not on bail. No charge, therefore no bail needed.

True, and I am sure the police are well aware of this. They have the whole AG's department to advise them. But I think they took a calculated risk. Who in the group of 171 arrested will dare to come forward and sue the police back? They also probably already checked that a Mr. Pang is not in the group of 171. There is not going to be another Mr. Pang in Malaysia.

This comment is probably made in a jest and lack of some thoughts. Which Singaporean will spend 3 times more just to teach Malaysian politicians a lesson?

 

No doubt, many businesses in JB flourish with the Singaporean spendings. Without them, many may not survived, or at least you would not see so many new businesses sprouting around town. Although this too brings the side effect of cost getting higher in JB, but it is better to see these JBians flocking to Singapore every morning to work.

 

If anyone desires to meddle in another country affairs, shout to the politicians, and not to the innocent people making decent livings everyday.

I regret having made arrangements for a KL visit for early January.

Even though I had no plans to visit KL gay venues anyway, this raid has really soured my view.

I prefer not to contribute my few dollars to them if I can help it

The one near the door was the Malay guy I’d met earlier in the sauna. He had his towel on. The other guy, sitting in the opposite corner, was naked with a towel covering his genital area. I chose to sit in the middle. The steam was quite heavy, but I could still see that the naked guy had a nicely toned body and smooth skin—really caught my eye. He was staring at the floor, so I couldn’t see his face at first. Then suddenly he looked up, and I was shocked—it was my therapist. Lol. He looked really attractive in that steamy atmosphere.

 

Then another three patrons came in. I recognized two of them: the owner (a Chinese guy) and another therapist (can’t remember his name). They all sat together in the corner. That’s when it crossed my mind: the steam room is one place where there’s occasionally some action, other than the showers. One night, there were even six people having light fun in there. So I started wondering about the situation:

 

Were the staff wanting to join in?

Were they just observing or supervising?

If some actions happened, what would be their reaction?

Or were they simply there to warm up because of the cold night?

 

I was thinking, they could use the facilities all night long when the place closes, but they still chose to join the patrons. And I can say that night the attendance was quite good.

 

For me, the situation felt awkward, though I’m not sure about the others. The staff were all sitting together, just chatting. I even thought, what if someone didn’t realize they were staff and tried something—what would happen? Haha. As the situation got more awkward, I decided to leave, shower, and head straight to the locker. The first Malay guy in the steam room also left shortly after. And that was that.

 

Just wanted to share something amid the tension everyone feels now with all the recent raids on saunas. With everything happening, I’m not sure if I’ll have the courage to visit TeMan again, even though I think their place is safe and less likely to be raided.

No male massage therapist is ever straight in such places catering for man-only spa. Either bisexual or bicurious or gay. And, the owner is well aware that most of the clienteles coming to places like this are gay. Based on your story about the encounter in the steam room, they are definitely enjoying the benefits of each other. But just not in front of customers or they are just being cautious. No "Straight" guys ever go to male-only spa for men's touch lol. Besides, their ads on social media are so giving out gay vibes.

 

Best now is to stay away any men-only spa that include steamroom and sauna facilities. This is a very trying time for gay spa owners and frequent patrons. Any time of any day one could get arrested and charged just for going to these places. Not to mention there is a bunch of prostitute dens in petaling street raided yesterday.

 

Anyway, does TeMan allow walk-in to use only the sauna/steamroom or just exclusively for massage paying customer only?

In fact Shy straight men told me even if they are afraid to undress , they rather choose to be massaged by ladies than to be pressed by another men
