THE CONSTITUTIONAL CHALLENGE

Gary and Kenneth, a Singaporean gay couple of 15 years, have filed a constitutional challenge against Section 377A of the Singapore Penal Code, which criminalises sex between gay men. 

On April 2013, the High Court ruled against the couple and retained the anti-gay law. Gary and Kenneth have decided to file for an appeal.

 

The cost of mounting a constitutional challenge adds up to a substantial figure. As friends of the couple, we are helping by raising funds for their legal challenge and seeing them through this long and difficult journey.

  BACKGROUND

S377A of the Penal Code states that:

"Any male person who, in public or private, commits, or abets the commission of, or procures or attempts to procure the commission by any male person of, any act of gross indecency with another male person, shall be punished with imprisonment for a term which may extend to 2 years."

Singapore is one of the few Asian countries, and the only advanced economy in the world, which still criminalises homosexuality. We believe this constitutional challenge is a rare opportunity to set things right and take our place among the many Asian and first world nations that do not have such a law.

While the Government of Singapore has said that S377A would not be proactively enforced, the fact is that is has been used, and its existence is a threat to all gay men. As it is, S377A - even if unenforced - also stands in the way of the fight against discrimination of the entire LGBT community in society, at the workplace, as well as the way LGBT people are portrayed in the mass media.

 

FUNDS NEEDED

The US$50,000 (approx. S$62,000)* we aim to raise through crowd-funding will go into the legal and court fees of the constitutional challenge. This amounts to only a part of the funds that needs to be raised. The rest of the funds will be raised through other forms of private donations.

In the event that fundraising is in excess of the expenses of the constitutional challenge, surplus funds will be donated to LGBT-related causes in Singapore.

*The currency of contributions for this campaign is in USD because Indiegogo does not process SGD.

 

WHO WE ARE

We are members and allies of Singapore's LGBT community who are deeply moved by the couple's courage. Among us are individuals who are straight and gay, and we do not believe a person should be fearful of being imprisoned because of his sexual orientation.

Gary and Kenneth have bravely stood forward on behalf of all LGBT people in Singapore. Let us come together and show the couple our support.

Sorry, let me know how to contribute to the fund. I salute them and for the fact that they are fighting for the silent majority over a most taboo and sensitive issue, this is the least we should do.

I think there is no need to bring attention to this issue. PM Lee has promised that police will not actively enforce such act. The section is just there for symbolic reason. By bringing unnecessary attention to this law, it will only force the conservatives to retaliate further. Wait till the law is actively enforced! Moreover, our learned judge has given a very good explanation on why this law is not unconstitutional. Please go and read up. Thank you.

@-con- it's not about whether or not the law is actively enforced or not. It's about what it symbolizes every single second minute hour and day it stands there.

There are countries run by their own government by belong to other countries, like what singapore was before independence. Isn't that sufficient? Isn't that enough? No...they say. They want to be independent--completely independent. It's symbolism and everything. That's why there are fights for belief and terrorism. We need this

Share it. spread awareness, then let others think and decide what they will.

Interestingly, you will find more people on FB who are not gay sharing this on their timeline, than gays/lesbians.

Why? I wonder non-gays donate more as well?

There is presently an Indiegogo fundraising campaign to help the couple bring their case to the Court of Appeal. 

S377A of the Singapore Penal Code states that:

I just feel very little being talked about here in this forum but most of my Facebook friends who spread this news viral are non gays.

What about you? 

Did you see more non gays spreading this on Facebook than gays?

i don't see how is it important whether its gays or non gays who spread the word more, its not a competition. For the campaign to have raised the targeted amount in such a short time, it shows that there are many people who support this fight and that is what counts :)

Sure you are right.

Let's do our part then to raise more awareness to every member of this forum.

This campaign is only the start of many good things to come.

We need not have such a small target in mind as it can grow to support many other causes.

The target is on how many people will be aware of this cause.

Let's not forget the human rights lawyer who made this all possible and who has brought us to where we are now - M. Ravi.

In this video recorded yesterday during the launch of his autobiographical book entitled "Kampong Boy" at The Arts House, he answers a question about why he initiated the challenge to the constitutionality of Section 377A:

The judgement of Ravi's case on behalf of his client, Tan Eng Hong, is still pending.

I am one-quarter through M. Ravi's autobiography "Kampong Boy" just launched yesterday and I must say that Ravi is not only a brilliant and compassionate lawyer, he also has a gift for prose. 

 

Even if he had not decided to become a champion for the oppressed, his life story itself would still be colourful and dramatic enough to make for an engaging read. 

 

It forms an integral part of the Singapore Story and is a valuable contribution to the growing body of local literature.
