He had hung out with the alleged assailant, Jeffrey Pe, that evening to celebrate the completion of his full-time National Service. On Wednesday (Sept 21), Pe, now aged 45, began standing trial in the High Court. The Singaporean is contesting three charges of sexual assault by penetration. He claims that his alleged victim consented to the acts. The younger man, who is now 25 and is a Singapore permanent resident from the United Kingdom, cannot be named due to a court order to protect his identity. He testified behind closed doors on Wednesday, with reporters and the public not allowed to attend the hearing. 'EXPLOITED NAIVETE': PROSECUTION In their opening statement, Deputy Public Prosecutors (DPPs) David Khoo and Tay Jia En told the court that Pe exploited the younger man’s “naivete and trusting nature to commit a slate of serious sexual offences against the victim when he was at his most vulnerable”. The pair got to know each other at Hero’s pub along Circular Road in July 2017. They exchanged phone numbers and later met on July 30 at a bar to celebrate Pe’s birthday. The DPPs said Pe had learned that the alleged victim recently broke up with his longtime girlfriend and was looking to meet people, in particular girls. “The accused thereafter gained the victim’s trust by showing that he was a sociable and extroverted person who could introduce the victim to people to expand the victim’s social network,” the prosecutors added. They next met in the wee hours of Aug 6 that year, when the younger man asked Pe over social media application Snapchat if he wanted to drink. However, Pe fell asleep. The other man continued drinking with his friends at Clarke Quay. The pair subsequently met on Aug 8 that year to celebrate the younger man completing his full-time NS. They had several alcoholic drinks at a restaurant and some pubs in the Chinatown area, before taking a taxi to Pe’s condominium. The alleged victim had felt drunk and asked Pe if he could “crash” at Pe’s place. There, Pe made him an alcoholic beverage and offered him a change of clothes, as well as to sleep on his bed. He declined before falling asleep on the floor of Pe’s bedroom. VICTIM DEVELOPED ANXIETY DISORDER Sometime later, the young man woke up to find Pe allegedly performing oral sex on him. Pe also purportedly used his own fingers to penetrate him anally twice. The alleged victim, who was semi-unconscious, then pushed Pe away and went to the toilet to wash up. He left the unit and called his friend, saying Pe had raped him, before calling the police. Pe was arrested a few hours later. The prosecution said they will lead evidence from 26 witnesses to prove the charges beyond a reasonable doubt. This includes two Singapore General Hospital doctors who examined the alleged victim, as well as an Institute of Mental Health (IMH) psychiatrist who will testify that he was likely to still be drunk during the sexual acts and therefore unable to consent. Another IMH psychiatrist is also set to testify that Pe does not suffer from any mental illness. A National University Hospital psychiatrist had diagnosed the alleged victim with an anxiety disorder with possible post-traumatic stress symptoms, having examined him around August 2018. DPPs Tay and Khoo added in their opening statement: “Every Singaporean son will fondly remember his Operationally Ready Date, where he is formally released from full-time NS duties. "Alas, not so for the (alleged) victim. Instead of fond memories, he is instead left with indelible scars of National Day 2017, and he had to seek professional help to overcome the trauma he received from the incident.” The trial is set to continue for the rest of the week. Von Ling Wei Hao, a Singaporean who was working as a compliance officer with an investment management firm, pleaded guilty to eight charges related to voyeurism. This time, he replied that he was changing. Deputy Public Prosecutor Yohanes Ng said: “He was panicking and stalling for time.” After getting changed, Ling exited the cubicle and denied that he was filming the victim. However, he eventually handed his phone to a staff member, who called the police. So when one victim made an accusation in 2020, they went through the list and interviewed everyone who was ever his subordinate in the SPF to see if there were more victims. That's when all the other policemen victims revealed their encounters. It's hard to say as the entire matter is shrouded in secrecy, as is usually the case for misconduct within the uniformed government departments. If the guy was their reporting officer, and also in-charge of their appraisal and promotion, most likely the junior policeman will just keep quiet about it. After all, if there was no evidence, it's very much "my word against his word", and more likely, people may not believe the words of a rookie policeman who accuses a veteran and experienced policeman of molest. Singaporean Jeffrey Pe, 45, had in September last year claimed trial to three charges of sexually penetrating the victim, then aged 20, on Aug 9, 2017. The victim cannot be named due to a gag order protecting his identity. As part of his defence, Pe had argued that before the sexual encounters, the victim had indicated he was exploring his sexuality and had shown romantic interest in him. Pe claimed that the acts in two of the charges were consensual while denying the act in the last charge. VICTIM'S ACCOUNT UNUSUALLY CONVINCING Delivering the verdict, Justice Mavis Chionh observed that in cases where the only witness is the victim, the victim's evidence must be found to be "unusually convincing" or must be corroborated. Having reviewed the evidence and submissions, the judge found that the victim in the present case was an "honest witness" whose evidence was unusually convincing. "Not only was the complainant’s evidence unusually convincing, I am also satisfied that there was other evidence in this case which corroborated his account of the alleged offences. "Not only did the complainant consistently deny the accused’s claims of a consensual sexual encounter, but he also consistently told numerous third parties – his friend, the police, and doctors at the Singapore General Hospital (SGH) – that he had been sexually assaulted; and he made these complaints at the first reasonable opportunity – indeed, within a very short time of the alleged offences," said Justice Chionh. Referring to audio recordings of calls the victim had made to the police after the incident, the judge said: "I could hear for myself the state of emotional distress the complainant was in." During his examination by doctors, the victim had also provided an account that was consistent with his testimony during trial, the judge noted. According to the prosecution, Pe met up with the victim on Aug 8, 2017. The two consumed alcoholic drinks before heading to Pe's residence. At the apartment, Pe made the victim an alcoholic drink. The victim fell asleep on the floor of Pe's bedroom and awoke sometime later to find Pe sexually assaulting him. ACCUSED IS DISINGENUOUS In contrast, the judge rejected Pe's argument that there were material inconsistencies in the victim's account before and during the trial, as these focused chiefly on differences in terminology and were immaterial to the victim's credibility. "I find (the accused) to be a disingenuous witness whose claims about the complainant's alleged romantic interest in him and the complainant’s alleged expressions of interest in exploring his sexuality were not at all borne out by the objective evidence before me," she added. The accused attempted to suggest that the victim was flirtatious or seductive in his text messages, but there was nothing to show that the victim had been romantically interested in or sexually attracted to Pe, the judge said. She also dismissed the accused's suggestions that he was intimidated by police officers or that there were inaccuracies in his statement. In fact, the accused had penned and signed beside the amendments on his statement, she noted. They conversed over WhatsApp in the meantime. Pe met the victim at a bar on Jul 30 to celebrate the former's birthday. On Aug 6, 2017, the victim allegedly wanted to meet Pe to drink, but the older man fell asleep before they could meet. Pe apologised and both agreed to meet two days later for drinks. On Aug 8, the victim met Pe at night and they consumed alcoholic drinks in the Chinatown area before the victim allegedly asked to sleep at Pe's residence. The prosecution said it would lead evidence to show that on Aug 9, Pe made the victim an alcoholic drink and offered the younger man a change of clothes and his bed to sleep in. The victim allegedly declined the clothes and the bed, falling asleep on the floor of Pe's bedroom in his own clothing. He awoke sometime later to find that his jeans and underwear had been pulled down, and Pe was sexually assaulting him, the prosecution alleged. Drifting in and out of consciousness, the victim mustered the strength to push Pe away. The victim then went to the toilet to wash himself, disgusted with what had happened, the prosecution continued. The victim later called a friend and confided that Pe had "raped" him. The victim called the police on Aug 9, at about 5.47am, stating: "A guy just tried to rape me. I have known him for a few weeks, he was very intoxicated. He is at home right now." Pe was arrested at his apartment at about 10.30am. The prosecution will lead evidence from analysts from the Health Sciences Authority to show that while the victim's blood sample contained 40 mg of ethanol per 100 ml of blood, no ethanol was detected in Pe's blood sample when it was taken. An Institute of Mental Health consultant will give evidence that the victim was likely to have been intoxicated between 4.15am and 5.30am on Aug 9, and was therefore unable to consent to the sexual acts. On Monday, Pe, now 45, was sentenced to 10 years’ jail and 12 strokes of the cane by the High Court. He was found guilty in April on three counts of sexual assault by penetration. Pe had contested the charges in a trial that began in September 2022, denying some of the acts and contending that the victim had consented to the other acts. He claimed that the victim was open to exploring his sexuality and was romantically interested in him. But Justice Mavis Chionh rejected his defence. She found that the victim was intoxicated after a night of drinking and incapable of consenting to the sexual acts performed on him by Pe. The victim, who had just broken up with his long-time girlfriend, was interested in a woman at the pub and decided to befriend Pe, who appeared to be connected to her. Pe invited the victim to his birthday party on July 29, 2017, and the duo exchanged mobile phone numbers. Both began to chat on WhatsApp, talking about women and about Pe’s upcoming party. On the day of the party, the victim brought a few of his friends along but had minimal interaction with Pe. In the early hours of Aug 6, 2017, Pe invited the victim to his home for drinks, but the meeting fell through. The duo subsequently met on Aug 8, 2017 for a night of drinks. When the victim asked Pe whether he could “crash” at the accused’s place, the older man agreed. There, Pe gave the younger man an alcoholic drink, and the victim fell asleep on the floor of the bedroom in his own clothes. He woke up sometime later to find the accused performing oral sex on him. As the victim drifted in and out of consciousness, Pe continued to sexually assault him. After he pushed Pe away, the victim washed himself in the toilet, as he felt disgusted with what the accused had done to him. He then left the unit and called a friend, who advised him to call the police. Pe is appealing against his conviction and sentence and is out on $80,000 bail. The teen, who was 17 at the time, had been thinking of skipping school as he felt ostracised and felt he had no purpose in life, so his mother had reached out to the offender for help. The 49-year-old man, whose identity is under gag order along with details of the school and the subject he taught, had pleaded guilty to one count of showing sexual material to the teen. A second charge of possessing over 1,000 obscene video files was taken into consideration. At the time of the offence, the man had been teaching for more than 22 years. The victim was in year 6, the equivalent of junior college year 2. The offender was the boy's form teacher since 2020. In January 2021, the victim's mother emailed the teacher, seeking help for her son as she wanted to find out how he was doing in school. The teacher told the teen's mother that he had noticed the boy was very withdrawn, less cheerful, tired and falling behind on schoolwork. They agreed for the teacher to find a chance to speak to the victim. When the teacher spoke to the boy after class, the teen confided that he had been having negative thoughts and engaged in self-harm to cope with his emotions. The man then gave his phone number to the victim, suggesting that it be saved under a different name as their conversation was "not exactly legit". The boy went home and told his mother what happened, expressing surprise and gratitude that an adult man could understand him so well. The teacher began texting the boy. At the same time, he lied to the boy's mother that he had obtained the green light from the school to handle the boy on his own. In February 2021, the teacher led the boy to a consultation area in the school and gave him a self-help book. They began talking and discussing coping mechanisms for emotions. The teacher told the victim that males of his age had only two ways to destress - "medication and masturbation". This made the boy uncomfortable. The teacher then began asking the boy sexual questions and showed him some links to pornographic websites. He invited the boy to his flat a few days later, where he talked to the boy about watching porn and his experience visiting sex workers while on holiday in Bali. Neither the victim nor the accused had told the victim's parents about this meeting. The teacher kept plying the teen with alcohol, continued to ask him sexual questions and showed him pornographic videos. The boy tried to avoid watching them, and the teacher noticed his discomfort. When the teen wanted to leave, the teacher only booked a ride home for him about an hour later as he wanted the smell of alcohol to dissipate first. The boy said that when he got home, he realised that "there was some immorality" in the teacher's behaviour. He told his mother about it the next day. The matter was escalated to school authorities and the vice-principal filed a police report. The teacher resigned that same month. After his arrest, he said he had reached out to the victim out of genuine concern for the boy's well-being. However, he said he also felt depressed and "starved of companionship", and thus crossed boundaries. He was assessed at the Institute of Mental Health and found to have major depressive disorder, benzodiazepine use disorder and some personality disorder traits. However, these conditions had no causal link with his offences, and he was fit to plead in court. SENTENCING SUBMISSIONS The prosecutor had sought three months' jail, noting that the offence was relatively new, with no direct precedents to refer to. Instead, the prosecution referred to precedents for similar offences such as sexual exploitation of a child or young person or exhibiting obscene objects to minors. Deputy Public Prosecutor Yvonne Poon said the accused was the victim's form teacher and had abused this formal position of trust. On top of this, he further cultivated a personal relationship of reliance and independence between himself and the victim, making an effort to gain the latter's trust. He was sentenced to 11 months' jail on 17 July 2023 - Monday. A male taxi driver came onto his 14-year-old passenger, first touching the boy then molesting and groping him, despite the latter rejecting his advances. The 14 year old victim has a boyfriend of the same age when both of them boarded the taxi.
