There have been cases. The problem is that cases are not listed by the sections and there is no publication who has been charged by what.

 

The 20 year period is not accurate. The last well known were this Tan who took up the challenge to 377A as being charged in Sept 2010 for oral sex.

Note that nowadays since the last amendment in 2019 (into effect on 1 Jan 2020) 376 covers penetrative gay sex (Oral or anal) when there is no consent, which leads to the result that 377A is often not applied as it is secondary to other sexual offences.

 

Another case was in 2008 following a police report by a 16 year old.

 

Here the excerpts on the position as laid down by one of the former Attorney-Generals:

 

The former Attorney General has clarified in a speech on 2 Oct 2018 that the Government has not removed or restricted prosecutorial discretion for Section 377A.

He noted that former A-Gs Walter Woon and V.K. Rajah "have recently suggested that it is not desirable for the Government and Parliament to direct the public prosecutor (PP) not to prosecute offences under Section 377A of the Penal Code, or to create the perception that they are doing so.

 

"Such comments may give rise to the inaccurate impression that the exercise of the PP's discretion has been removed or restricted in respect of section 377A".

 

A-G Wong stressed that the police, when conducting investigations into an offence under 377A, "will decide whether or not there is sufficient basis to refer the case to the PP". "It will then be for the PP to determine whether to prosecute.

 

To illustrate this point, he cited an example of how, in 2008, then Deputy Prime Minister and Minister for Home Affairs Wong Kan Seng "explained that in the case of an offender who had been charged under Section 377A of the Penal Code, a police report was lodged by a 16-year-old male who had oral sex with the suspect".

The police referred the case to the PP after completing investigations, A-G Wong said, and the PP "decided to charge the accused under Section 377A after taking into account all the facts and circumstances of the case, including the complainant's age and the fact that the offence had taken place in a public toilet".

 

A-G Wong noted: "The PP’s exercise of prosecutorial discretion has always been, and remains, unfettered.

 

Conclusion:

The problem in such scenarios will arise for example and what you can take from above if one man changes his view after having engaged in gay sex and later claims it was not consensual or when the sex partner is in the 16 to 18 age range (and lodges a report later on).

 

Being charged on 377A is therefore (even in consensual situations) hanging on thin air (as it remains at the discretion of the Public Prosecutor to investigate, charge ...).

For the 1st scenario, I see no difference in treatment vs the straight.  For the 2nd scenario, in fact S377A is invoked in good cause to protect the impressionble minors aged 16 to 18 from sexual predators who targetted these minors. This should serve as a deterence message to the sexual predators.

 

I have  checked up the 2010 case cited by singalion. For that case, Tan was prosecuted for having oral sex with another guy in the public toliet. Again, S377A is invoked  to a good cause similiar to the public nuisance offence when straight couples made love in public places. In no way have I seen that the invokement of S377A is strictly to prosecute gays for their sexual preferences. Why are some people so afraid of S377A ? Is it because of the crimes that some have committed or going to commit other than purely on their sexual preferences ... hmm...

SINGAPORE - A man used a parang to stab his older male friend in the abdomenafter the latter, who had supported the offender financially, decided to end their friendship.

 

A district court heard on Thursday (Oct 28) that the pair also had an argument as the younger man, now 29, refused to be intimate with his HIV-positive friend.

 

After the attack, the 44-year-old victim was rushed to hospital and had to have a small part of his bowel surgically removed.

 

The Singaporean offender, who appeared in court via video-link, pleaded guilty on Thursday to 10 charges for offences including voluntarily causing grievous hurt with a weapon and multiple drug-related crimes.

 

He cannot be named due to a gag order to protect the victim's identity.

 

The court heard that the two men lived together from May 2018 in a rental condominium unit.

 

Some time after 9pm on Aug 17, 2018, the younger man returned home with another male friend.

 

It was not stated what the pair did there but the younger man left the unit at around 5am the next day.

 

About two hours later, he had an argument via text messages with the victim as the older man was upset and wanted the end their friendship.

 

The older man left their home soon after and returned at around 11pm.

 

Deputy Public Prosecutor Theong Li Han said: "When he arrived at the unit, the accused confronted him at the door and placed the pointed edge of a parang knife on the left of the victim's neck.

 

"The accused asked the victim where he had gone. The accused and victim then got into a verbal dispute, during which the accused pointed the parang at the victim."

 

The pair also argued about the victim's HIV- positive status and the younger man's refusal to be intimate with him.

 

After about 10 minutes, the accused and the victim calmed down. The victim then went to a bedroom and fell asleep.

 

At around 4am on Aug 19, 2018, he woke up and noticed that the younger man was not in the bedroom. He also realised that his wallet, NRIC and laptop were missing.

 

The DPP said: "The victim started panicking after he was unable to open the bedroom door as he assumed that it had been locked. The victim proceeded to kick the bedroom door while shouting the accused's name and accusing him of locking the door.

 

"There was no reply from the accused. Shortly thereafter, the accused opened the bedroom door while the victim was still standing behind the said door in the bedroom."

 

The younger man then used a parang to stab his friend's abdomen and the victim fell onthe bed in pain.

 

The victim asked his attacker to call for an ambulance. The younger man did as he was told before leaving their home with the weapon.

 

The victim was taken to the Singapore General Hospital and was found to have penetrating injuries to his small bowel. A small segment of it was later surgically removed.

 

He recovered and was given 27 days of hospitalisation leave.

 

Besides this offence, the younger man also committed offences including methamphetamine possession and consumption.

 

He is expected to be sentenced on Dec 16.

Offenders convicted of voluntarily causing grievous hurt with a weapon can be jailed for up to 15 years and fined or caned.

Excuse me, this is the nation's news agency reporting. We have to be very careful in the choice of words in reporting to avoid any mention of the s** word between the parties lest it brings the reminder of S377A. While some gays wouldn't be bothered by such reporting but do note there is a group of scared, insecured paranoid gays who are thinking that the government is out to catch them and put them into jail. We wouldn't want to create panic and trigger these people to emigrate or leave Singapore secretly to seek for unnecessary asylum. Already there are 2 of these people in these thread. Please spare a thought for these people.

 

We are already busy keeping track on the affairs of the world and are now caught up in the price bidding war. We don't want any additional shit on the matter. So yeah, subtlety is key to stability and harmony.

SINGAPORE - A 53-year-old man who molested two boys, aged 15 and 20, on public buses, was sentenced to four years' jail on Friday (Nov 5).

Nooraman Mohd Noor pleaded guilty to two counts of outrage of modesty, and another two similar charges involving victims aged 12 and 18 were taken into consideration for sentencing.

This is the sixth time he has been sentenced for outrage of modesty offences since 1997.

In the last case before this, he was sentenced to two years and three months' jail in May 2019 for molesting a 31-year-old man on the MRT.

On Friday, the court heard that on Jan 21, at around 6.30pm, his first victim, a 15-year-old secondary school student, boarded a bus and sat in the last row.

Nooraman sat next to him and leaned towards the victim such that their arms were touching.

He then groped the victim's groin area and touched him over his pants, positioning his hand in such a way that it was covered by his long-sleeved shirt.

The victim stood up immediately and walked away. He later lodged a police report.

Nooraman struck again less than a month later.

On Feb 8, at around 5.15pm, he groped the groin area of a 20-year-old polytechnic student as they were boarding a bus at Woodlands interchange. Shocked, the victim confronted him.

He later called the police. The victim told the police that Nooraman was "wearing female attire, came and groped my private parts and just walked off".

The offence was captured on closed-circuit television cameras.

That same day, Nooraman molested an 18-year-old polytechnic student while alighting from a bus and touched the groin area of a 12-year-old boy at Ang Mo Kio MRT station while on an escalator.

Seeking four years in jail, Deputy Public Prosecutor Victoria Ting said Nooraman should be sentenced to the maximum punishment as he was a recalcitrant offender.

"While his modus operandi of opportunistic offending in public transport has remained consistent, the number of victims has escalated. The age of his victims has also gotten younger. Two charges at hand involve 12 and 15-year-old victims," said the DPP.

 

In mitigation, Nooraman's lawyer, Ms Sofia Bakhash of Lexcompass LLC, said her client suffered from schizophrenia and his actions were precipitated by the fact that he had not abided by his treatment plan.

Ms Bakhash added that the degree of sexual exploitation was "minimal" as there was no skin-to-skin contact. While she agreed that there might be psychological impact on the victims, she urged the court to consider that her client's actions were fleeting.

The offence of outrage of modesty carries a jail term of up to two years, or a fine, or caning, or any combination of such punishments.

SINGAPORE: A 56-year-old man who met a 15-year-old boy for paid sexual services was sentenced to 14 months' jail on Tuesday (Nov 16).

 

Fauzan Juma'at pleaded guilty to three charges – sexual penetration of a minor, committing an indecent act with a young person and procuring an indecent act by a young person.

 

Another three charges were considered in sentencing.

 

The court heard that the victim, a 15-year-old boy, decided in January 2020 to provide sexual services for money. He posted an advertisement on Locanto offering sexual services in exchange for cash. 

 

Fauzan came across the ad and responded to it. He exchanged numbers with the victim and they began chatting on WhatsApp.

 

On Jan 31 last year, Fauzan asked the victim for a photo of his buttocks, and the victim complied. After this, they agreed to meet, with Fauzan offering the victim S$200 for sexual services. He drove his van to pick the victim up.

 

While leaving the car park, the victim asked if they could engage in sexual activity at the car park, and Fauzan agreed, said the prosecutor.

 

He parked his van and the pair proceeded to the back where they engaged in sex acts after Fauzan paid the victim S$200.

 

Fauzan subsequently received a message from the victim's phone. It was the victim's mother, asking him what he had done with her son. He cut up his SIM card and threw it away.

 

In February 2020, the victim's mother lodged a police report and said she suspected her son was providing sexual services. 

 

Fauzan was arrested in March 2020 and his laptop and handphone were seized.

 

The prosecutor sought at least 15 months' jail. Fauzan, who was unrepresented, asked for leniency and apologised.

 

"Your honour, I'm very sorry," he said. "I just want to say very sorry to what happened. I just want to have some leniency for me ... and sorry for what happened, very sorry."

 

He said his aged mother was not very well and needed his financial support.

 

For sexual penetration of a minor, he could have been sentenced to 10 years' jail and fined.

 

For committing or procuring an indecent act with a young person, he could have been jailed up to five years and fined up to S$10,000.

The court should not let this culprit off so easily just because of that lame excuse of "exploring his sexuality."

 

A heavy jail sentence should be imposed on him so as to set a deterrence against boys or guys who want to take spy pictures or videos of guys relieving themselves in the washrooms. Enough is enough  ! Guys, be it straight or gay should be accorded the same protection treatment as the ladies to ward off these perverts. 

 

Think twice on the consequences before you let your dicks do the thinking for cheap thrills that will ultimately ruin your career and create a criminal record on your lives !

SINGAPORE - While in a toilet at Sengkang Community Hub, a 19-year-old male student noticed a man at the next urinal pointing a mobile phone at him.

 

The student, who was at the Hub to study, left the toilet quickly and later confronted the man outside it. What he found alarmed him - the man had a video of him at the urinal.

 

The incident, which occurred on March 7, 2019, was reported to the police after a security officer was notified.

 

The student was not the only victim. Lim Xu Sheng Shaun, 21, had taken 13 photos and 19 videos of 15 men using toilets at various shopping centres and other public locations around Singapore.

In court on Wednesday (Nov 17), Lim pleaded guilty to one count of harassment for the offence involving the student.

 

He also pleaded guilty to four counts of public nuisance for similar offences that took place between Feb 23 and March 7, 2019.

 

Deputy Public Prosecutor Nicholas Lai told the court that Lim was a student when he committed the offences. The DPP did not name the school.

 

Lim took photos and videos of men using the toilets at Compass One shopping mall on three separate occasions.

 

One of the incidents occurred just hours before he targeted the student at Sengkang Community Hub, a building across the road from the mall.

 

Lim had also secretly taken a video of two men relieving themselves in a toilet at the National University of Singapore on Feb 25, 2019.

 

He took the video with his mobile phone while standing beside the victims.

 

DPP Lai said that when Lim was confronted during investigations with the videos and photos, he admitted to taking them without the victims' knowledge and consent.

 

He said that he would view what he had recorded for a few days before deleting them.

 

The DPP added: "He did so because he was curious about guys and was exploring his sexuality."

 

District Judge Kessler Soh called for a report to assess Lim's suitability for probation before his sentencing on Dec 15.

 

For harassment, Lim could be fined up to $5,000, jailed for up to six months or both.

 

He could be jailed for up to three months, fined up to $2,000, or both for each public nuisance offence.

SINGAPORE - Three men tried to extort $60,000 from a married businessman after one of them, who was his personal assistant at the time, secretly recorded him having sex with a male partner on at least five different occasions.

 

The 53-year-old victim managed to lower the proposed sum to $50,000 and the trio decided to accept the offer.

 

But all three offenders were arrested on March 13 last year and charged in court the next day before any money could change hands.

 

One of them, Daryn Ho Yong Jian, now 24, was on Friday (Nov 19) sentenced to 18 months' jail after he pleaded guilty to one count of criminal intimidation.

 

The Singaporean was the third offender linked to the case to be dealt with in court.

 

Two other men - the victim's former employee and Tan Yong Jian - were given jail terms earlier this year after they admitted to their offences.

 

The businessman and his former personal assistant, 24, cannot be named due to a gag order.

 

In late 2019, the personal assistant secretly installed a camera in the businessman's home.

 

He set the device to motion notification mode so he could be alerted through an application on his mobile phone when someone was in the room.

 

He was able to view the goings-on in real time and make recordings. He left the camera in the businessman's house for about three weeks.

 

During that time, he managed to record his boss having sex with another man on at least five occasions.

 

On March 9 last year, the employee met Tan, then 24, and Ho and showed them the videos.

Deputy Public Prosecutor Zhou Yang said that the trio were aware that the victim was a "person of means" and decided to use the videos to extort money.

 

They agreed that the employee would get 50 per cent of the extorted sum while the other two would each get 25 per cent.

The employee sent his two friends the videos and gave them the businessman's contact number.

 

The employee and Ho later deleted the videos from their mobile phones to avoid detection, leaving only Tan in possession of them.

 

Later that day, Tan inserted an unregistered SIM card into his mobile phone and sent the businessman three videosand the following message: "I have some videos and pictures at my disposal that I think will be of interest to you."

 

When the victim did not reply, he sent another message and said he would share the clips. The businessman lodged a police report on March 10 last year.

 

The offenders waited for a reply but did not receive any.

 

DPP Zhou said: "They decided that they should proceed with their extortion attempt and... decided to demand $60,000 in cash from the victim."

At 7.14pm on March 12 last year, Tan sent the victim a message stating: "60k for these videos and pictures to be deleted and not leaked. Let me know your decision."

 

The businessman replied later that evening, stating that he needed time and could possibly "squeeze out" $50,000. The trio decided to accept the offer.

 

The businessman suspected that one of his personal assistants, who had access to his home, could have recorded the videos and the trio were arrested on March 13 last year following an investigation.

 

While out on bail, Tan persisted in the extortion attempt and roped in another man, 29-year-old Mahadevan Edwyn, whose case is pending.

 

On Friday, Ho's bail was set at $30,000. He was also told to surrender at the State Courts on Dec 9 to begin serving his sentence.

Man repeatedly molested male tutee, 15, then begged parents for forgiveness

SINGAPORE — A part-time tutor molested a 15-year-old boy during a tuition session and later knelt to beg the victim's parents for forgiveness.

 

It was not the first time the married man had touched the boy, who is in Secondary 3.

 

The man, 43, was jailed for 8 months on Thursday (25 November) after he pleaded guilty to one charge of molest. One count of possessing obscene films was considered for his sentencing.

 

 

Both the tutor and the victim cannot be named to protect the victim’s identity.

 

In 2018, the victim’s family engaged the man, who also worked as a Grab driver, to be the boy’s mathematics tutor. The man taught the victim in the living room of the victim’s home every Saturday from 7.30pm to 9pm. He would sit beside the boy on a long bench.

 

In June last year, the boy told his family that the tutor had touched him. The family assumed that the touch was accidental or a misunderstanding and did not stop the man’s services. Instead, they arranged for tutor and tutee to sit on separate chairs for future sessions.

 

This did not deter the man.

 

On 29 August last year, as the boy was having his usual tuition session, the man felt an “uncontrollable sexual urge” to touch him, said the prosecution. Over 20 minutes, he touched the boy’s right hip and thigh, as well as the boy's crotch.

Stunned, the victim did not know how to react for some 15 minutes. He then summoned the courage to stare at the tutor, who immediately pulled his hand away.

 

A few minutes later, as the boy worked on some questions, the man touched him again on his thigh with his left hand. The boy asked why the man had touched him and the latter apologised.

 

The boy stood up to walk to his parents room, intending to tell them about the molest.

 

“However, the accused pulled the victim’s arm and begged him not to tell his parents about this. The victim then started to shout for the accused to let him go, which alerted the victim’s parents,” said Deputy Public Prosecutor Bryan Joel Lim.

 

The boy told his parents what had happened, spurring the man to kneel on the floor to beg for forgiveness. He asked the parents not to call the police, but the boy’s father did so at 9.29pm.

 

In mitigation, the man said that he was married with a wife and two children, whom he needed to support financially.

DPP Lim sought nine months' jail, stating that the court needed to send a strong message that such an abuse of trust would not be tolerated.

 

For molest, the man could have been jailed up to two years, or fined, or caned, or with any combination of the penalties.

Jail for postgraduate student who took intimate videos of man in toilet

SINGAPORE - A postgraduate student was in a toilet at a local tertiary institution when he used his mobile phone to capture two videos and a picture of a man performing a sexual act in an adjacent cubicle.

 

Myanmar national Han Win Tun, now 31, was caught red-handed when the 25-year-old victim saw the device and alerted campus security.

 

Police arrived soon after and Han Win Tun's mobile phone was found to contain 17 obscene videos of men with their private parts exposed.

 

The court heard that he had shot them at various toilets islandwide.

 

On another occasion, he used his mobile phone to record videos of a man and a woman having sex in a dormitory at the tertiary institution.

 

Details about it cannot be disclosed due to a gag order.

 
 

Han Win Tun was on Tuesday (Jan 11) sentenced to 13 weeks' jail after he pleaded guilty to four charges including insulting a woman's modesty and making obscene films.

 

He was at the tertiary institution on May 21, 2019, when he looked through a dormitory window opening and saw the couple having sex.

 

He then positioned his mobile phone towards the opening to record several videos of them.

 

Han Win Tun struck again at around 2pm on Aug 16 that year when he captured two videos and a picture of a man who was performing a sexual act in a toilet cubicle.

 
 

Deputy Public Prosecutor Emily Koh said: "Subsequently, the victim spotted the accused's mobile phone with its camera facing him, from above the cubicle partition. The victim immediately went out of the second cubicle. The victim walked towards the outside of the third toilet cubicle, where the accused was, and told the accused to stay still while he called for campus security.

 

"While the accused remained inside the third toilet cubicle, the accused deleted various photographs and videos that he had previously taken, including those of the victim in the moments prior, from his mobile phone."

 

Han Win Tun stepped out of his cubicle and campus security turned up soon after. The police were alerted at around 2.30pm that day.

 

The court heard that the authorities seized Han Win Tun's mobile phone and other electronic devices including his thumb drives as well as memory cards.

 

The devices were later found to contain 91 obscene films.

 

On Tuesday, DPP Koh urged the court to sentence him to at least 14 weeks' jail, stressing that most of his voyeurism victims were unaware that he had filmed them.

 

Defence lawyer Cory Wong from Invictus Law Corporation pleaded for his client to be given not more than 12 weeks' jail.

Mr Wong said that the Myanmar national did not complete his postgraduate studies here and has since been suspended.

 

Han Win Tun's bail was set at $15,000 on Tuesday and he was ordered to surrender himself at the State Courts on Feb 8 to begin serving his sentence.

SINGAPORE — A man in his 60s, who is a prominent figure in the Catholic community here, was charged on Thursday (Jan 20) with sexual offences against at least two teenage boys more than a decade ago.

The Singaporean cannot be named due to a gag order issued by the courts, which bans the publication of his identity, designation and occupation, the alleged victims' identities and the school where the alleged offences took place.

Gag orders are usually imposed when there is a need to protect the identity of the victims or witnesses. These typically involve crimes where sexual violence or children are involved and the gag orders last indefinitely.

The accused faces two charges of carnal intercourse against the order of nature, which falls under Section 377 of the 1985 revised edition of the Penal Code that was repealed in 2007.

He was also charged with two counts of sexual exploitation of a child or young person under the Children and Young Persons Act.

Court documents stated that sometime between Jan 1, 2005 and Dec 31, 2006, the man allegedly engaged in oral sex with the older boy, then aged between 14 and 16.

He then purportedly made the younger boy, then aged between 14 and 15, do the same sometime between April 2007 and December 2007.

The man is further accused of committing an indecent act with the boys in 2005 and 2007 by performing a sex act on them.

On Thursday, the man’s lawyer Edmond Pereira told the court that he is not recording any plea at this stage.

A police prosecutor asked for the accused to be remanded in the prison's Complex Medical Centre (CMC) for psychiatric observation, in order to find out if he was “suffering from an abnormality of mind that could have impaired his mental responsibility for his acts”.

However, Mr Pereira said that his client had not been told of the possibility of being remanded on Thursday, and asked if he could report for the remand period on Monday.

The defence counsel noted that the accused was called up by the police in "May last year" and returned to Singapore from abroad to address these matters.

They then gave the investigation officer several psychiatric reports and he was then told a few days ago that he would be charged in court, Mr Pereira added.

District Judge Terence Tay initially said that he would defer the remand issue till next Monday, and set the accused’s bail quantum at S$30,000. But after speaking to his client, Mr Pereira then told the court that he has chosen to be remanded immediately.

The accused’s bail conditions include staying away from the vicinity of the alleged incident location, as well as not contacting the alleged victims and any other prosecution witnesses.

He will return to court on Feb 10 following his psychiatric evaluation.

Those convicted of committing carnal intercourse against the order of nature can be jailed for life or jailed for up to 10 years and fined.

SINGAPORE: Former radio disc jockey Dee Kosh intends to plead guilty to the sexual offences he has been charged with, a court heard on Tuesday (Jan 25).

Lawyers from Eugene Thuraisingam's firm informed the court of the intention of their client, 33-year-old Darryl Ian Koshy, to plead guilty. He was given a date to do so, on Mar 10.

Kosh was given seven charges in August last year for offences including communicating with a minor for the purpose of obtaining sexual services, attempted sexual exploitation of a young person, making an obscene film and possessing an obscene film.

He is accused of offering a 16-year-old boy up to S$2,000 in February 2017 and offering up to S$1,000 to a 17-year-old boy in July 2018 so he could perform sex acts on them.

Kosh is also accused of attempting to procure an indecent act by a 15-year-old boy between March 2018 and June 2018 by asking the boy to perform sex acts on him.

Kosh rose to fame as a YouTuber and later became a presenter on radio station Power 98. He was placed on no-pay leave pending the investigations and later suspended after he was charged.

In August 2020, he allegedly offered another 17-year-old boy S$1,000 for the teen to perform oral sex on him.

If convicted under the Children and Young Persons Act of attempted sexual exploitation of a young person, he could be jailed for up to five years, fined up to S$10,000, or both.

If found guilty of communications for the purpose of obtaining sexual services of a minor, he could be jailed for up to two years and fined.

The penalties for making an obscene film are a jail term of up to two years and a fine of between S$20,000 and S$40,000. The punishment for possessing obscene films are a maximum of six months' jail, a fine of up to S$20,000, or both.

It also leads to the myth and misunderstanding that if all discrimination and rejection were to be removed from the community, there would be no more suicides.

The question is: Would be removing discrimination and rejection of homosexuals be harmful to the community?

I refer to Dr Chan Lai Gwen’s letter, “Attributing suicide among LGBTQ to discrimination is over-simplistic and unhelpful” (Jan 24).

 

On suicide and self-harm in the lesbian, gay, bisexual, transgender and queer community, I said at a dialogue on LGBTQ issues held by non-governmental organisation The Whitehatters: “The cause is not (being) LGBTQ in and of itself, but the experience of being LGBTQ, that space of being discriminated, that space of being told you are not good enough, that we’ll reject you."

 

Dr Chan misunderstood my remark as attributing “suicide/self-harm to a single cause of the experience of being discriminated or rejected for identifying as LGBTQ”. 

 

I agree suicide is a highly complex issue with many contributing factors, and discrimination and rejection for identifying as LGBTQ are among them.

 

Psychiatrist Adrian Wang said in 2019: “One of the most depressing things LGBTQ people face is when they are not accepted by their own family members.”

 

I have journeyed with many LGBTQ persons who have had experiences with suicidal ideation and self-harm, and have known, sadly, quite a few who took their lives.

 
 

The irony is the simple things Dr Chan says can avert a crisis — such as a listening ear or being given a sense of hope for tomorrow — are what many LGBTQ persons feel they don’t have. 

 

When they fear rejection from their family, friends and religious community, they have nobody to talk to. 

Being authentic may mean getting rejected or hurt, and they further isolate themselves and lose hope.

 

The late Archbishop Desmond Tutu said: “There comes a point where we need to stop just pulling people out of the river. We need to go upstream and find out why they’re falling in.”

 

Pulling people out of the river is necessary but insufficient. We must move away from reacting to suicidal crises to preventing them. 

 

While Dr Chan advocates ways to help persons at risk of suicide, we must also address the contributing factors. 

 
 

A study by the Family Acceptance Project at San Francisco State University, published in 2018, showed rates of attempted suicide by young LGBT people whose parents tried to change their sexual orientation were more than double (48 per cent) that of young LGBT adults who reported no conversion experiences (22 per cent). 

 

Suicide attempts nearly tripled for young LGBT people who reported home-based, parental efforts to change their sexual orientation and intervention by therapists and religious leaders (63 per cent).

 

It is not my intention to blame or induce guilt, but to invite people to become aware of the possible effects of their actions. 

 

It would be irresponsible of me not to speak up for those harmed by conversion therapy or rejection by the church, or both. 

 

I appreciate the approach the dialogue took because it required us to listen to understand, rather than refute. 

 

This creates safe spaces where people who may hold opposing views can come together to listen to one another and reach a better understanding of one another’s positions.

She and another female youth church leader Felicia were both were full of icy stares and super wary towards each other, but when facing other youths will both try to outdo each other putting on that bubbly home coming prom queen persona brimming with messages of positivity and love from god. It felt like such a farce.

SINGAPORE - A freelance instructor, engaged on a contract basis to teach dance to children, molested two boys on separate occasions at their primary schools.

 

The 42-year-old Singaporean man was on Thursday (Jan 27) sentenced to three years and 10 months' jail with six strokes of the cane after he pleaded guilty to three molestation charges.

 

He cannot be named owing to a gag order to protect the children's identities.

 

Some time in mid-2016, the first victim, who was about nine or 10 years old at the time, was preparing for a dance performance at his school when the man came over to adjust the child's costume.

 

The man then molested the boy, who froze in fear and did not resist.

 

The pupils, two teachers and the man later went to the dance room of the school after the performance for a debriefing.

 

By then, the victim had changed out of his costume into his physical education attire.

 

Deputy Public Prosecutor Chong Ee Hsiun said: "Halfway through the debrief session, the accused walked to the back of the room while the other teachers were still speaking and sat behind the first victim. Suddenly, the accused wrapped both arms around the first victim's waist and slipped both hands into the victim's shorts and (molested him).

 

"The skin-to-skin contact lasted about 15 to 20 seconds. The first victim was again shocked by the accused's touch and froze in fear."

 

The boy was traumatised by what had happened but did not know how to broach the issue with adults.

 

He attended a sexual education class in late August 2020. After doing so, the boy decided to tell a teacher and his mother about the "inappropriate touches". He alerted the police the following month, the court heard.

 

Meanwhile, the court heard that the man was at another primary school in November 2019 when he molested his second victim - a 10-year-old boy.

 

In February 2020, the pupils from the dance group, their teachers and the man were in a bus travelling from the school to a performance venue when he molested the boy again.

 

The second victim attended sexual education classes eight months later before he told his teacher about his ordeal.

The matter was escalated to the school management and a police report was made soon after.

 

In an earlier statement to The Straits Times, the Ministry of Education (MOE) said that the man has since been deregistered from its registry of instructors and is no longer engaged by any school.

 

Its spokesman said: "MOE is committed to providing a safe learning environment for students.

 

"MOE takes a serious view of instructors whose conduct compromises the safety and well-being of our students and will not hesitate to take firm action against them, including immediate termination of their services and permanent debarment from providing their services in schools."

 

The man's bail was set at $8,000 on Thursday and he was ordered to surrender himself at the State Courts on Feb 3 to begin serving his sentence.

 

For each count of molesting a child below 14, an offender can be jailed for up to five years and fined or caned.

I've encountered guys who used that tactic before - pretend to talk on the phone very loudly in the changing room while walking up and down, but actually, they are filming other guys who are showering or changing.

But they added that it bore “little relevance” to the proceedings.

“Almost without exception, every human being struggles at different times and to varying degrees with personal circumstances,” said the tribunal, according to their grounds.

“The call of a doctor requires that he overcomes his struggle without harming another. If he is not able to do so, to then have the courage to find help in addressing the challenge."

 

Sophistry! Then what for mention his personal struggles? I can also say his personal conduct not during his job, whether legal or not, got nothing to do with his profession. As if all doctors are automatically saints. What kind of delusion is the tribunal labouring under???

 

“There is indeed nothing to be ashamed of and everything to be gained from understanding one’s sexual orientation and ensuring that it is expressed in a way that does not compromise the interests of others.”

SINGAPORE — A man filmed other men in a toilet by concealing his mobile phone under his armpit while standing beside them at urinals.

 

Nicholas Kwang Zhen Xing, 24, filmed at least 37 illicit videos of men engaged in private acts between 2018 and 2020 at male toilets in Sentosa, Bishan Swimming Pool, Ang Mo Kio Hub and Plaza Singapura.

 

He also took videos of a male neighbour changing in his home.

 

Kwang was jailed for 30 weeks and fined $900 on Wednesday (9 February), after he pleaded guilty to 10 out of 38 charges for voyeurism, making obscene films, and being a public nuisance. The remaining charges, which are of a similar nature, were considered for his sentencing.

 

Kwang’s offences came to light after a police report was lodged on 23 October 2020 stating that obscene videos had been found in a shared folder on Google Drive, according to the prosecution. He was one of the persons with access to the folder. Kwang had intended to upload the videos to his own Google Drive, but had mistakenly upload them to the folder.

 

Court documents did not reveal who lodged the police report.

 

From January 2018, Kwang had been recording obscene videos of men using urinals of showers of public toilets with his handphone concealed under his armpit. He would leave the camera lens exposed and pointing towards the victim while recording.

 

If filming victims in cubicles, he would hide in the neighbouring cubicle to record them through gaps or over the top of cubicle walls. He also began taking videos of his male neighbour undressing around the same time.

 

On 9 January 2018, after midnight, he noticed his neighbour changing clothes. Kwang used his mobile phone to record the man for more than two minutes, capturing his genitals.

 

Kwang had recorded the videos for his own pleasure. He recorded at least 37 videos, of which at least 31 were obscene, between January 2018 and October 2020. The videos were from 30 seconds to more than four minutes long.

 

Deputy Public Prosecutor Yee Jia Rong sought at least 34 weeks’ jail and a fine $900 for Kwang, arguing that Kwang had taken steps to ensure his victims were unaware of his actions, which constituted a high degree of intrusion.

 

The sentence that the prosecution sought was commensurate with the length of Kwang’s criminal conduct, which spanned nearly three years, and would likely to have continued if Kwang had not been discovered after accidentally uploading some videos into a shared folder, said the DPP.

 

Kwang’s lawyer Sukdave Singh urged the court to call for a suitability report for mandatory treatment order for Kwang. But the prosecutor objected as Kwang’s psychiatric conditions were not deemed to have contributed to his behaviour.

Singh said that his client had a long history of anxiety disorder from his primary school days. Kwang has showed the ability to reform as he had full parental support, and has shown the potential to do well in his academic results, stated the lawyer.

 

While the lawyer said that Kwang had sought voluntary treatment at the Institute of Mental Health before the offences came to light, these were for depression and anxiety. Kwang was only later diagnosed with voyeuristic disorder.

 

District Judge Lim Wen Juin noted that Kwang’s intention to upload the videos on his personal folder did not appear to be consistent with a desire to rehabilitate himself as he seemed to save the material for future consumption.

 

The judge found that Kwang’s depression and anxiety did not contribute significantly to the offences, and that treatment of these conditions would not reduce his likelihood of reoffending.

SINGAPORE - A 19-year-old teen took photos and videos of 15 men using toilets at various public locations around Singapore because he was "curious about guys", the court heard.

Shaun Lim Xu Sheng, now 22, was on Thursday (Feb 24) sentenced to 18 months' probation.

As part of his probation, he has to remain indoors from 10pm to 6am every day and perform 80 hours of community service. His father is also bonded for $5,000 to ensure his good behaviour.

He had pleaded guilty to four counts of being a public nuisance and one count under the Protection from Harassment Act.

Another 11 similar charges were taken into consideration in his sentencing.

 

Deputy Public Prosecutor Nicholas Lai told the court earlier that Lim was a student when he committed the offences between Feb 23 and March 7, 2019, but did not say where he studied.

 

Lim had taken 13 videos and 19 photos of men using toilets at various locations including the National University of Singapore (NUS), Compass One Shopping Centre in Sengkang and Nex mall in Serangoon.

 

In one instance on Feb 23, 2019, Lim placed his mobile phone over a toilet cubicle partition in Compass One Shopping Centre and took three videos and six photos of a man without his knowledge.

 

He struck again on Feb 25 that year at NUS and took a video of two men urinating. He stood beside the victims, pretending to use the urinal.

In the harassment offence, Lim pointed his phone in the direction of a man's genitals in a toilet in Sengkang Community Hub.

 

When confronted, Lim said he had taken a video but claimed that it was accidental.

Said DPP Lai: "After the man saw that the accused had recorded him urinating, albeit his (genitals) were not captured in the video, he got upset as he felt harassed and alarmed by what Lim did."

 

A security officer at the community hub learnt what had happened and lodged a police report.

Investigations found that Lim would view what he had recorded for a few days before deleting the videos. "He did so because he was curious about guys and exploring his sexuality," said the DPP.

 

For harassment, Lim could have been fined up to $5,000 and jailed for up to six months.

Each public nuisance offence carries a maximum penalty of a three-month jail term and a $2,000 fine.
