SINGAPORE — Despite having tested positive for the human immunodeficiency virus (HIV), a sex worker did not disclose his condition to clients and even had unprotected sex with an acquaintance.

On Tuesday (Nov 21), Mohamad Fazni Mohamad Azini, 38, was sentenced to three years and three months' jail after pleading guilty to one charge under the Infectious Diseases Act for engaging in sexual activity with another person without disclosing his HIV infection.

 

WORKED AS A SEX WORKER

At the time of the offences, Fazni worked as a transgender streetwalker in the Geylang area where he offered sexual services to men for between S$50 and S$350. 

Even though he was HIV-positive, Fazni did not inform any of his male customers about his HIV status, which he had known about since being diagnosed in October 2007.

In June 2018, Fazni had unprotected sex with one client, and the following month had protected sex with another client. These offences were the basis for the two charges for which he was convicted in July.

SINGAPORE – A male former secondary school teacher was sentenced to 20 weeks’ jail on Nov 22 after he assumed fake identities online and sent multiple victims sexually explicit material.

 

Tay Tong Wei, 36, had gone online with fake identities, including that of a woman, as he wanted other netizens to share their sexual experiences with him.

 

The private tutor, who taught at a school from 2013 to September 2019, sent sexually explicit videos and pictures to multiple victims of both sexes who were aged between 15 and 20 at the time.

 

In October, he pleaded guilty to six counts of distributing obscene material by electronic means.

 

He also admitted to one count of instigating one of his victims to do likewise. Forty other charges were considered during sentencing.

 

Tay committed the offences between 2015 and 2019. His victims included three men and three women, who cannot be named because of a gag order to protect their identities.

 
 

In earlier proceedings, the prosecution said that some time in 2013 or 2014, Tay discovered that he derived pleasure from chatting with others about their sexual experiences.

 
 

He then set up a Facebook profile, claiming to be a woman called Jasmin. He also set up profiles under the name of “Mike” on Facebook and Snapchat.

 

Deputy Public Prosecutor Sheldon Lim had earlier said: “The accused created (them) with the intention of talking to strangers about sexual topics. The accused hoped that these sexual conversations would lead to these strangers sharing their sexual experiences with him.”

 

While posing as “Jasmin” in November 2015, Tay came across the Facebook profile of a 17-year-old girl and asked to be her online friend. The teenager, who was referred to as V1 in court documents, accepted the request, and they started chatting.

 

“Jasmin” then started broaching various sexual topics with V1. The teenager, who thought that she was talking to another girl of the same age, eventually grew comfortable discussing topics of a sexual nature with “Jasmin”.

 

“Jasmin” later introduced V1 to “Mike”. V1 and “Mike” also started talking about sexual topics soon after.

 

Through the “Mike” account, Tay offered to buy V1 a sex toy, and she agreed to accept it.

 

 

Tay then bought the item, which he left on a bench near her home so that she could pick it up.

 

Posing as “Mike” and “Jasmin”, Tay also sent to V1 pictures and videos of people engaging in sexual acts. V1 later recorded a video of herself performing a sexual act and sent it to “Jasmin”.

 

Tay befriended his other victims in a similar manner before sharing obscene material with them.

 

On Feb 5, 2019, V1 made a police report, stating that she had exchanged videos of a sexual nature with one “Jasmin”.

 

Officers managed to ascertain Tay’s identity, and he went to Jurong Police Division five months later to record a statement.

 

They later seized from him two laptop computers and a mobile phone. Forensic examinations of the devices revealed the existence of more victims.

 

Tay’s bail was set at $5,000 on Nov 22 and he is expected to surrender himself at the State Courts on Dec 6 to begin serving his sentence.

 

For each count of distributing obscene material by electronic means, an offender can be jailed for up to three months and fined.

 

 

The point I have to make here is that the girl who reported him, deliberately send her nudes and videos of sexual nature to him....

Suspended teacher gets 8 years’ jail for sex acts against boys when he was student volunteer

SINGAPORE - He was a lauded student volunteer with a welfare organisation that ran a student care centre for children from low-income or troubled families, but he had a dark secret that stayed hidden during his later career as a teacher.

 

Between 1992 and 1996, he committed sexual acts against three young boys. His offences were not exposed for more than 20 years.

 

On Aug 6, 2019, one of his victims, who was sexually abused when he was between 10 and 12 years old, mustered the courage to come forward after reading a news article about victims of sexual crimes.

 

The police report lodged by this first victim, now 40 years old, eventually led to the disclosure of the accused’s offences against two other victims.

 

The second victim, now 39 years old, was between nine and 12 years old when he was abused, while the third victim, now 36, was between five and eight years old when he was abused.

 

On Nov 27, the perpetrator, who is now 48 years old and suspended from teaching, was sentenced to eight years’ jail after he pleaded guilty to one count of committing an indecent act with a child and two counts of committing unnatural sex, an offence that has been repealed.

 
 

Eight other similar charges were taken into consideration.

 

 

 

Prosecutors told the High Court on Monday that the perpetrator did not reoffend while he was a teacher. He cannot be named under a gag order to protect the identities of the victims.

 

In response to queries from The Straits Times, a spokesperson for the Ministry of Education (MOE) said the individual has been interdicted from duty since August 2019, and is no longer teaching in any school.

 

“MOE takes a serious view of staff misconduct and will take disciplinary action against those who fail to adhere to our standards of conduct and discipline, including dismissal from service,” said the spokesperson.

 

 

The perpetrator was between 17 and 20 years old at the time of the offences. He was tasked with supervising children who were receiving childcare services and after-school programmes at the centre.

 

Between 1993 and 1994, during a private tutoring session, he told the first victim to sit on his lap while the boy was naked from the waist down. He then slapped the victim’s genitalia when the boy gave incorrect answers to his maths questions.

 

On another occasion, after everyone else had left the centre, he took the second victim to the children’s playroom and committed an indecent act with the boy.

 

He started having contact with these two victims outside the centre’s operating hours, but no concerns were raised, as he was trusted by the staff and by the boys’ parents.

 

 

He continued his sexual assault while he gave the two boys private tuition at the second victim’s home when the child’s parents were not in.

 

On one occasion, he exposed himself to the first victim and forced the boy to perform oral sex on him.

 

 

Between 1992 and 1995, he performed oral sex on the third victim on three occasions, while giving private tuition to the boy at a medical hall owned by the boy’s mother. He also tried to make the third victim perform sexual acts on him, but the boy successfully pulled his hand away.

 

 

In mitigation, defence counsel Rai Satish said his client was a relatively immature teenager when the offences were committed, and that he was trying to understand his sexual awakening.

 

He said his client remained crime-free after these offences because he learnt that what he had done was wrong and inappropriate behaviour.

 

The haggard-looking offender also read out a letter, sobbing as he apologised to the victims and to his own family for the hurt he caused them.

 

Deputy Public Prosecutor Tay Jia En said the victims were still scarred after more than 20 years.

 

The prosecutor said the third victim’s relationship with his mother was strained because she did not believe what the accused had done to him, while the first victim suffered confidence issues.

SINGAPORE – A routine check by police officers patrolling near Changi Beach exposed a serial sexual predator, after his phone was found to contain child pornography and a text message to an underage boy offering cash for oral sex.

 

On Friday, the 35-year-old self-styled part-time religious teacher, who is HIV-positive, admitted that he committed various sexual offences against four boys, including one he met on dating app Grindr when the boy was 11 years old.

 

He pleaded guilty in the High Court to three charges of sexual penetration of a minor relating to three of the boys. Another 18 charges, including one involving a fourth boy, were taken into consideration.

 

The man, who was diagnosed with paedophilic disorder after his arrest, cannot be named under a gag order to protect the identities of the victims.

 

Prosecutors sought 24 years’ jail and eight strokes of the cane for the man, arguing that he was sexually irresponsible and was inconsistent with the use of condoms while carrying out sex acts with the victims.

 

The man’s lawyer asked for 16 years’ to 18 years’ jail and no caning, saying that his client was remorseful and had taken the boys to the mosque to pray for forgiveness after the acts.

 
 

The case was adjourned for further sentencing arguments. No hearing date was fixed.

 

In a statement on Sept 11, the Islamic Religious Council of Singapore (Muis) said the man was not and has never been registered under the Asatizah Recognition Scheme (ARS), which means he is not authorised to offer any form of religious instruction or guidance in Singapore.

 

“This case is a timely reminder to individuals and parents to only seek instruction and guidance from ARS-registered religious teachers,” said the statement.

 

The man started providing religious and Arabic language home tuition in 2013 after he returned from his studies in Egypt. He also worked part-time as a food delivery rider.

 

He tested positive for HIV, or human immunodeficiency virus, in February 2019, following unprotected sex with an adult male partner.

 

Deputy Public Prosecutor Zhou Yang told the court that the man got to know a primary school boy, identified as V1, on Grindr in 2014.

 

V1 had pretended to be a teenager, but the man was aware that the boy was below 14 at the time, said the prosecutor. The man told the boy he was a part-time religious teacher, and they chatted about sex.

 

They eventually met in person at a toilet cubicle in Hougang Mall, where the man performed oral sex on the boy.

 

From 2015 to 2018, the two remained in contact and met up for mutual sex acts. In July 2019, V1 tested positive for HIV, although it cannot be concluded that the accused had transmitted the virus to him.

 

In 2017, the man got to know a 12-year-old boy, identified as V2. They played video games and went on e-scooter rides together, and the man often bought V2 and his friends food and cigarettes. He also tutored V2 in maths.

 

On three occasions in 2018, when V2 was 13, he allowed the man to perform penetrative sex acts on him, in exchange for $30 worth of video game credits each time.

 

The third victim, V3, was in primary school in 2016 when he started chatting with the man, who had followed the boy on Instagram.

 

After the two of them met in person, the boy treated the man as an older brother. The man often bought V3 presents, including a second-hand video game console.

 

After a while, the man began touching the boy. The prosecutor told the court that the boy did not like it and felt it was “weird” but he relented because the man persisted.

 

Between 2017 and 2018, the man engaged in penetrative sex acts with the boy, who was then 14 to 15 years old.

 

In the time they knew each other, the man paid for food and cigarettes when he went out with V3 and his friends, and also lent money to the boy’s family members when they needed it.

 

In June 2019, after he was aware that he was HIV-positive, he did not tell V3 about this before they engaged in sexual activities.

 

Later that month, the man met V2 and two other underage boys near Changi Village, and bought vodka to share with them.

 

At about 10pm, patrolling police officers conducted a spot check on the group, and arrested the man.

SINGAPORE – A male teacher who molested an 11-year-old boy on five occasions in their primary school between 2017 and 2018 was sentenced to four years’ jail on Friday.

 

Before handing down the sentence, Senior District Judge Bala Reddy said he found that the 44-year-old teacher’s offences were not premeditated, and that they were instead random and opportunistic.

 

The judge also found that the victim had not been subjected to violence.

 

The prosecution had earlier urged the court to sentence the offender to between 54 and 66 months’ jail. It also asked for him to be given between five and 15 strokes of the cane.

 

Deputy public prosecutors Lim Ying Min and Angela Ang said that the teacher’s acts of abuse had affected the victim greatly.

 

“This impact also led to practical consequences in the victim’s life – from the loss of his love for (a uniformed group that the teacher had handled) to his unfortunate failure of his O-level examinations, as a result of the re-traumatisation he experienced in the course of trial,” they said.

 

In August, the teacher was convicted of five molestation charges after a trial. The offender, who cannot be named owing to a gag order to protect the victim’s identity, has been suspended from duty since November 2018.

 

In earlier proceedings, DPPs Lim and Ang said in their submissions that the victim has a fractured family history.

During the trial, the victim testified that his relationship with his stepfather was “not good”.

 

The prosecutors said: “The (stepfather) would beat and scold him... and would do so with his hand or his belt. The victim would end up with bruises on his face or belt marks on his arms as a result.”

 

They added that the victim was also not close to his mother, as she was focused on her newborn daughter.

 

In 2016, the boy joined a school uniformed group which the offender was in charge of. The victim started confiding in the teacher about his family problems the following year.

 

The man then asked the boy if he wanted to be his godson and the child agreed.

 

The prosecutors said: “So close was their relationship that even the victim’s mother came to rely heavily on the accused in her efforts to manage the victim.”

 

However, she was unaware at the time about the godfather-godson relationship that the offender and victim agreed to.

During the trial, the victim testified that the teacher molested him for the first time in November 2017. The teacher targeted the boy four more times in 2018.

 

The offences came to light after the victim showed his brother a picture of the teacher, the court heard.

 

The brother jokingly remarked that the teacher looked “gay” and asked if the man had touched the victim. The victim turned silent before admitting that the teacher had molested him.

 

The brother told their uncle about the conversation, and the man alerted the victim’s mother.

 

She later contacted the victim’s form teacher and a police report was lodged soon after.

 

The teacher, who was represented by lawyer Gino Hardial Singh, had claimed that the victim had fabricated the molestations because he did not buy the boy a bicycle.

 

In their submissions, the prosecutors said that the teacher had earlier expressed every intention to buy the victim a bicycle as a gift.

 

The prosecutors added that the victim’s uncle had also testified that it was him and not the teacher who had disallowed the victim from accepting such a gift from the teacher as it was deemed to be too expensive.

 

In his mitigation, Mr Singh had asked the court to sentence the teacher to three years’ jail, and stressed that the offences were not premeditated.

 

The lawyer also said: “The touching did not involve any skin-to-skin contact (and) the duration of the said touches was fleetingly short as they lasted no more than a few seconds.”

 

On Friday, Mr Singh said that his client will be appealing against the conviction and sentence.

 

This is the second reported case this week about a teacher being sent to jail.

 

In an unrelated case on Thursday, another male teacher, 38, was sentenced to 16 weeks’ jail after pleading guilty to an offence under the Protection from Harassment Act.

 

He had impersonated a female former colleague and created a social media account in her name in December 2018.

 

From then until February 2021, the man used the account to hold 589 conversations with different people, most of whom were current or former students of the school.

 

Of these conversations, 49 were sexual in nature.

Ethan Yan Weilun, 46, was sentenced to 14 months’ jail on Jan 4 after pleading guilty to a charge of having sex with a minor. Three similar charges were taken into consideration for his sentencing.

Lim Kar Heng, 45, was sentenced to 10 months’ jail on Jan 3 after admitting to a count of having sex with a minor. Another charge of possessing 529 obscene films was taken into consideration for his sentencing.

Both men met their victims on Grindr in late 2021 while looking for people to have sex with.

Yan offered a teenager $50 for sex, and they met four times at the accused’s home between October 2021 and February 2022.

He knew the victim was between 15 and 16 years old at the time, and had asked the teen to introduce him to other boys of his age or younger.

Lim offered a different teenager $40 to perform an indecent act on him, and the latter did so at a multi-storey carpark in October 2021. He noticed the teenager looked younger than 18 – the minimum age required to create an account on Grindr – but did not ask for his age, the court heard.

 

Both men did not use condoms.

Their offences came to light when the victims spoke to school counsellors and lodged police reports.

In mitigation, Yan’s lawyer, Ms A. Meenakshi from IRB Law, said her client did not coerce or pressure the victim into engaging in sex acts, and there was no abuse of trust as they did not know one another prior to connecting on Grindr.

For sexual penetration of a minor aged above 14 but below 16, an offender can be jailed for up to 10 years and fined.

Lim offered a different teenager $40 to perform an indecent act on him, and the latter did so at a multi-storey carpark in October 2021. He noticed the teenager looked younger than 18 – the minimum age required to create an account on Grindr – but did not ask for his age, the court heard.

 

Both men did not use condoms.

Their offences came to light when the victims spoke to school counsellors and lodged police reports.

In mitigation, Yan’s lawyer, Ms A. Meenakshi from IRB Law, said her client did not coerce or pressure the victim into engaging in sex acts, and there was no abuse of trust as they did not know one another prior to connecting on Grindr.

For sexual penetration of a minor aged above 14 but below 16, an offender can be jailed for up to 10 years and fined.

Same like with underaged girls and men.

The underaged girl will solicit sex, receive money and presents from the guy.

And once they get bored with the guy, they will call the police and cry victim.

And they won't get any punishment. Only the guy will go to jail and get caned.

Why do these older guys prey on such young boys in the first place. 

 

The law places the duty to check on the age onto the adults. If no proof then just hold your hands and don't engage in fun.

It takes 2 hands to clap for such act. Hence, the laws serve to protect the minors, preventing the hands from clapping.

 

Even if the minors are naughty, as long as there are laws like this, it will deter the predators, who will think twice before committing such acts. Then the naughty minors will not be able to find another hand to clap with them. 

 

Imagine if there is no such law in place, the number of similar predators will increase to beyond imagination. Let our minors have what a proper teen life should consist of. Don't expose them to the perils of sex and desire too early.

I agree the kids were wrong for violating the terms of engagement for Grindr, but I think the kids were not punished because there is no law in the Penal Code that can be used to charge the kids - only Grindr could take action.  

 

I suppose Grindr will suspend the kids' accounts, but I don't think Grindr can do anything else. 

 

As for soliciting for sex as an underaged person, I feel the underaged person should also be punished, but I do not know under which statute.  I have a feeling the underaged person will be sent to some reform school or something similar, and that is about the extent of the "punishment".

Tuition teacher admits to molesting 3 students, one of whom was just 8 years old


SINGAPORE – A tuition teacher molested three of his students while teaching them in their homes, the youngest of whom was just eight years old.

Muhammad Nur Ikhlas Mohd Hashim, a 26-year-old Singaporean, pleaded guilty to three counts of molesting a person younger than 14 years old.

One of his two outrage of modesty charges that will be taken into consideration for sentencing involves a fourth victim, another eight-year-old boy, whom the accused molested at a void deck in April 2021.


The court heard that the accused was a Singapore University of Social Sciences student at the time of the offences, and was working as a part-time tutor earning $2,000 to $3,000 a month.

In early 2021, Ikhlas was hired to tutor a 13-year-old student in science every Saturday at 5.30pm. The lessons took place in the student’s bedroom with the door closed.

In June 2021, the student was working on a question when the accused, who was sitting beside him, touched his genitals over his shorts for at least a minute.


The student did not know how to react and remained silent. The accused then continued to teach the victim before molesting him a second time.

 

The student did not report the incident and continued to have lessons with the accused until December 2022.

Ikhlas’ second victim was an eight-year-old boy. He started tutoring the boy in mathematics in October 2022 and the sessions were held in the Primary 2 pupil’s bedroom with the door left slightly ajar.

The boy’s mother would sit in the living room and look into the bedroom occasionally.


Deputy Public Prosecutor Claire Poh said the boy addressed the accused as “Abang Ikhlas”, or brother Ikhlas in Malay, and they were on good terms.

After a month, the boy’s mother noticed that the tutor would rub her son’s back and poke his body, but she did not think much of it.

Between January and February 2023, the accused began placing the victim on his lap.

DPP Poh said Ikhlas was trying to get the victim to become accustomed to physical contact, so the boy would let his guard down when he molested him.


On Feb 26, 2023, the accused touched the boy inappropriately over his shorts while the latter was doing homework. Stunned, the boy did not know what to do and continued with his schoolwork. Ikhlas molested him two more times that day.

When the lesson ended, the boy informed his mother about what had happened. The mother fired the accused that day, but did not lodge a police report.

The third victim was a 13-year-old student, and Ikhlas taught him mathematics and science from March 2022. The lessons, which took place every Sunday from 1pm to 2.30pm, were conducted in the boy’s bedroom with the door closed. The Secondary 2 student, who was shy and introverted, noticed that Ikhlas liked to caress his thigh.

On March 26, 2023, the accused molested the victim. This shocked the boy, who moved away from the tutor.

The accused continued teaching as though nothing had happened and molested him again that day.

DPP Poh said the student was embarrassed about what Ikhlas had done to him.

She added: “He was initially reluctant to report the accused’s actions to his family. On April 1 that year, he plucked up the courage and told his mother.”


The victim’s sister lodged a police report two days later. The other offences came to light after the police started investigating.

DPP Poh sought a sentence of 2½ to three years’ jail with two to six strokes of the cane for the accused.

She said the accused had abused his position as the victims’ tutor and violated them in the sanctity of their own homes.

“He appears to have been emboldened by the fact that the first victim had not complained against him and moved on to target an even younger victim,” she added.

Ikhlas will be sentenced on Jan 16. For molesting a person under 14 years of age, an offender can be jailed for up to five years, fined and caned.

I do think this happens, yes. 

 

The underage kids who solicit for sex, when caught, would probably be sent for counseling.  I believe the counseling or whatever ends when they reach 18 years of age, and the system abandons them.  When that happens, I cannot blame the kids for going back to soliciting sex for money, this time as a legal adult.

Past criminal records for 377A can now be rendered spent because of repeal: MHA

 

SINGAPORE – The criminal records of those who were previously convicted under Section 377A of the Penal Code may now be rendered spent following the repeal.

Section 377A, which criminalised sexual activities between males, was repealed by Parliament in November 2022. Prior to this, these were registrable offences, and those convicted were given a criminal record.

The conviction would automatically be rendered spent after five years if the person remained crime-free during the period, unless the individual was disqualified under certain conditions, such as if the sentence exceeded three months’ jail or a $2,000 fine. This means the person would no longer have a criminal record for the offence.

But past convictions under Section 377A for consensual, private, homosexual acts between adults may now be rendered spent by application as well.

In 2022, the Ministry of Home Affairs (MHA) said there were 17 living people convicted between 1988 and 2007 over consensual, private, homosexual acts between adults. This was out of more than 250 living people who were convicted under Section 377A in the same period.

Mr Louis Ng (Nee Soon GRC) had asked Minister for Home Affairs K. Shanmugam about the criminal records of those convicted under Section 377A following the repeal.

In a written reply on Jan 9, MHA said that if a person’s conviction record cannot be automatically rendered spent, he can make an application to the Commissioner of Police to have his record treated as spent.

 

Those previously convicted under Section 377A may visit the police e-services website to check on their records.

MHA said that in considering the applications, the commissioner will look at the facts of the case, including whether it was a private activity and whether it was between consenting adults.

Those who wish to apply to have their 377A convictions rendered spent should submit their application via e-mail to SPF_Spent_Application@spf.gov.sg with their personal particulars, contact information and reasons for consideration.

For what the prosecution called a "sustained campaign of harassment" on the teenager, Ng Mun Kwong, 54, was sentenced to 24 weeks' jail on Tuesday (Jan 9).

 

He had pleaded guilty to three charges for using criminal force to outrage the modesty of a person.

Four other similar charges were taken into consideration during sentencing.

The victim's name cannot be published under a gag order to protect the identity of the teenager.

 

INAPPROPRIATE BEHAVIOUR
The court heard that at the time of the offence, Ng was the assistant manager at fast food chain Shake Shack in Jewel Changi Airport, while the teen was a part-time worker.

On March 9 last year, the teen reported for work at 2.30pm and was asked to follow Ng to the male toilet on level four.

 

While they rode the escalator from level two to level four, Ng rubbed the teen's abdomen, close to his private part.

As this was the first time that Ng had touched him inappropriately, the teen tried not to think about it.

The teen's shift was supposed to end at 8.30pm, but Ng offered to let him work until 10pm. The teen agreed to the extension as he wanted to earn more money.

However, Ng informed the teen that since he would be working more hours, the teen would have to take an hour-long break with him.

Sometime after 4pm, Ng asked the teen to take a break and follow him to get food.

 

On the way to the fast food outlet, Ng placed his right hand over the teen's shoulders and rubbed his chest while they rode the escalator down.

This time, the teen pushed Ng's hand off his chest.

While they were waiting for their food, Ng repeatedly touched the teenager's thigh.

When the food arrived, Ng kissed the right side of the teen's neck before offering him an onion ring.

After eating, the teen was about to put his mask back on when Ng asked the teen to kiss him.

 

Even though the teen did not comply, Ng went on to kiss his cheek, near his lips.

Ng carried on hugging, kissing and touching the teen on various occasions throughout his shift.

The teen did not resist because he did not want to offend Ng who could refuse to give the teen working hours.

But the next day, the teenager reported Ng to the general manager.

Shake Shack suspended Ng, while the teen subsequently lodged a police report.

'EXPLOITED HIS POSITION OF TRUST'
Seeking a jail term of between 22 and 30 weeks, Deputy Public Prosecutor (DPP) Tung Shou Pin argued that Ng had exploited his position of trust as he was his superior who determined if the victim could work and what work he could do.

DPP Tung said that Ng was also persistent in inappropriately touching the victim on seven occasions on the same day, carrying out a "sustained campaign of harassment".

"Workplace sexual harassment is particularly heinous and victims are more vulnerable as their predator is someone who works closely with them and their peers, making it more difficult to put a stop to such acts," the prosecutor said.

For each charge of using criminal force to outrage the modesty of a person, Ng could have been jailed for up to three years, fined or caned, or with any combination of these punishments.

S'porean man, 35, sexually abused 4 underage boys he met online, gets 21.5 years' jail & caning
One boy had contracted HIV.

 

A man who preyed on four underage boys he met online was sentenced to 21.5 years in jail and eight strokes of the cane on Jan. 23, 2024.

The 35-year-old Singaporean, a "self-proclaimed", unauthorised religious teacher, pleaded guilty to three counts of sexually penetrating a minor and had 18 other charges considered for sentencing.

 

According to The Straits Times, the charges involved four different victims.

'Religious teacher', Arabic language teacher & food deliveryman
According to CNA, the offender worked part-time as a religious and Arabic language home tuition teacher and did food deliveries on the side in 2013.

The Islamic Religious Council of Singapore (MUIS) has said that the man was a "self-claimed" religious teacher and has never been registered under the Asatizah Recognition Scheme (ARS).

 

He was also not authorised to perform any form of religious instruction or guidance in Singapore.

 

Arrested by chance
Court proceedings revealed that the man met the three boys through the dating app Grindr, video games, or Instagram. The boys were between 11 and 16 at the time of the offences.

He sexually abused the boys over several years from 2014, offering them gifts such as a second-hand PlayStation or game credits.

 

The man found out that he had contracted HIV from an adult partner in February 2019 but continued his sexual crimes on one victim.

 

He was arrested by chance when police officers decided to check on him upon spotting him drinking alcohol with young boys near Changi Beach in June 2019.

They discovered child pornography on him and text messages in which he offered S$75 for a sex act with a boy.

 

One victim contracted HIV
After his arrest, one victim tested positive for HIV in July 2019.

Although it was inconclusive if the victim contracted it from the man, the prosecution noted that the man had nonetheless exposed his young victims to the risks of unprotected sex.

 

Asked not to be caned because 'physically frail'
The prosecution asked for a sentence of 24 years in jail and eight strokes of the cane.

 

They noted that the man was diagnosed with paedophilic disorder and assessed to be at a moderate to high risk of reoffending.

The prosecutor pointed out that there was an abuse of trust — not only was the man much older than the boys, but he also displayed "older brother behaviour", such as lending the victims money or giving them gifts.

 

The man's lawyer sought a jail term of 16 to 18 years, claiming that there was no abuse of trust and that the man was "physically frail", HIV-positive, and hence not suitable for caning.

 

The High Court judge was of the view that the offender's HIV status should be accorded little weight, as the defence said the man stopped having sexual contact with the first victim when he learned he was HIV-positive.

 

He ultimately sentenced the man to 21-and-a-half years in jail and eight strokes of the cane, adding that the prison authorities would decide whether he was fit to be caned.

Man convicted of repeatedly masturbating male patient recovering from procedure at Mount Elizabeth Novena Hospital

 

The patient testified that he was woken up by a sensation of something stroking his private parts multiple times. There was a "grip" like a hand around his penis, he said.

 

After some time, the person returned and lifted his gown to his chest area, said the patient.

 

"I could feel a sudden gush of cold air. My body was quite cold also and the stroking continued also with a flashlight when I woke up to it," he said.

Ok, by all means, I just wonder if such nurses don't have the guts to find anyone outside of their work place. Are they really so desperate to molest their patients?

I guess some guys outside hospitals would even offer to be "inspected" by them for free in their blue suit in some role play setting.

 

In fact the clinic doctor should also be censored in the quite unprofessional handling of the complaint by the patient.

Lawyers for Ivan Lee Yi Wang, a 35-year-old Singaporean, told the court that he will be appealing against the conviction and sentence. His bail amount was doubled to S$30,000 pending the appeal in the High Court.

 

Lee had contested two charges of molesting the patient in 2018. At the time, the patient was recovering from gastroscopy and colonoscopy procedures at a private clinic at Mount Elizabeth Novena Hospital.

During the trial, he denied doing this, saying the victim was biased against him and had imagined things because he was under the influence of sedatives.

The victim was 26 at the time of the offences. He worked in a market-related role and cannot be named due to a court order to protect his identity.

CNA's online search of the Singapore Nursing Board's records on Tuesday showed that Lee still has a practising certificate, and currently works at the National Kidney Foundation. His lawyers said he was asked to take a sabbatical due to his criminal case.

The Courts in such cases (also in straight cases) tend to believe the alleged victims.

 

Evidence based there is not much on the table. The incident refers to a my side of the version against the other's side of the version.

 

If it had been established that the culprit was in that room by other witnesses, then I don't think there is much left for an appeal.

Lee admitted it. Despite being asked not to enter the room.

 

The other part which was reported in earlier news articles was that the culprit sent a message to the victim on the appointment from his private number.

This is out of the usual practice for clinics also.

 

It seems Lee tried to get the attention of the other guy. Wouldn't wonder if the patient was gay also but angered by being sexually harassed at such a situation.

 

The thing I wonder is that no photo could be retrieved from Lee's handphone...

 

I don't think the appeal will come to any other outcome.

But if he is, he might have noted the advances at his first visits and through the nurse contacting him from his personal hp. 

 

What wonders me is that no forensic had taken place one the alleged culprits phone. 

 

The crucial point is when the victim made the police report. It could have been to late to recover deleted photos. 

 

I m also not sure whether the private pc , cloud storage of the alleged culprit had been examined. There might have been other photos of sedated patients. 

 

From the facts reported the police arrived on the same day after the incident at the clinic.

Looking at the evidence reported, it seems very thin to me. 

 

While I would never condone any such behaviour if it happened, I m not sure in a Western Court the nurse had been convicted on such a thin evidence base.

While I would never condone any such behaviour if it happened, I m not sure in a Western Court the nurse had been convicted on such a thin evidence base.

But in criminal law it is the procecution to prove behind "reasonable doubt" it was him. 

 

Was there no CCTV at the corridors? (To see whether he was at the room?). 

 

Can a court just rely on what the victim says?

Let's see what comes out in the appeal.

 

But you know, once judgment... must have a class A lawyer like in that maid case...
