Parti Liyani files court action to seek disciplinary proceedings against prosecutors in her case

SINGAPORE: Ms Parti Liyani, the former domestic helper of businessman Liew Mun Leong, has taken to court to seek disciplinary proceedings against the prosecutors in her case.

 

If she is successful, proceedings could be initiated to assess if there was any misconduct by the prosecutors.

 

Ms Parti's lawyer, Mr Anil Balchandani, attended a pre-trial conference in the High Court on Wednesday (Sep 23) against representatives from the Attorney-General's Chambers (AGC).

 

The hearing was for an originating summons under Section 82A of the Legal Profession Act, for disciplinary proceedings against legal service officers.

The respondents listed in Ms Parti's case are two deputy public prosecutors who dealt with her trial: Mr Tan Wee Hao, and Ms Tan Yanying. They are represented by AGC's Kristy Tan Ruyan, Jeyendran Jeyapal and Jocelyn Teo Meng Hui. 

 

An originating summons is a way to begin civil action and is based on affidavits filed to support the case. It is heard before registrars or judges.

If the Chief Justice grants Ms Parti leave for an investigation to be made into the complaint of misconduct, he may appoint a disciplinary tribunal. The tribunal will then hear the case and investigate the complaint, before submitting its findings to the Chief Justice. He can dismiss the complaint if the tribunal finds no cause of sufficient gravity for disciplinary action, or give orders to have punishments imposed.

 

Section 82A is concerned with misconduct by legal service officers or non-practising solicitors. If due cause is shown with proof that the legal service officer is guilty of misconduct befitting their post as an advocate and solicitor, they could be punished.

 

Penalties include censures, being struck off the roll, penalty of up to S$20,000, or any other order a disciplinary tribunal deems fit.

 

When approached by CNA, Mr Balchandani confirmed that the hearing took place on Wednesday but declined comment.

 

Ms Parti was acquitted earlier this month by the High Court of stealing S$34,000 worth of items from former Changi Airport Group chairman Liew Mun Leong.

 

This came after she was convicted in a lower court. In Justice Chan Seng Onn's judgment on her acquittal, he outlined several issues with the conviction findings and how the case was handled.

 

He noted the prosecution's use of a faulty DVD player in the hearing, saying that the fact that it was faulty was not disclosed to the trial judge nor to Ms Parti. If the prosecutor had known of the defect, they should have fully disclosed it, said Justice Chan.

 

If not, the trial court could be misled into thinking that the Pioneer DVD player was in good working condition when "questions were (and unfairly) put to Ms Parti ... on the basis that the DVD player was still in a good working condition after an incomplete demonstration of its important functionalities during the trial", he said.

 

In his judgment, he said the rule against introducing evidence from the bar should apply equally to both the prosecution and defence, and said the DVD player incident was "particularly prejudicial to Ms Parti" as she was not given a chance to test the player until the trial itself.

 

A week after the acquittal, Mr Liew announced he was retiring from his public service and business roles with Changi Airport Group, Surbana Jurong, Temasek Foundation and Temasek International.

The prosecutor who charged the maid and the one who accused the maid know each other. Prosecutor Tan Yanying's father is a friend/colleague of Liew. But Tan did not recuse herself from the case.

 

Also, Minister of Manpower Josephine Teo and Liew are connected to each other. Josephine Teo's husband works for Liew when MOM decided to only just give Liew an advisory without fine/punishment for the illegal deployment of his maid.

In 2012, an ordinary person was fined $7000 for the illegal deployment of his maid.

 

But in 2018, big shot elite Liew was only given an advisory without fine/punishment for the same offence. Liew is very, very rich and powerful and well-connected to people in the government and ministries.

Singapore — Deputy Prime Minister Heng Swee Keat says the high-profile court case involving former maid Parti Liyani shows that the country’s criminal justice system works.
 

Ms Liyani, who had been convicted of theft in March last year from the home of former Changi Airport Group chairman Liew Mun Leong, was acquitted on appeal by the High Court on Sept 4 this year.

 

Law Minister K Shanmugam delivered a Ministerial Speech on the case in Parliament on Wednesday (Nov 4). It also came up when Workers’ Party chairman Sylvia Lim’s Justice For All motion came up for debate in the House the same day.

 

Although the marathon debate in Parliament stretched close to midnight, Mr Heng took time to register his take on social media.

 

In a Facebook post published at 12.21 am on Thursday (Nov 5), he affirmed that Singapore’s success is built on the foundations of a clean government, a fair criminal justice system and equality for all before the law.

 

Noting that the case involving Ms Liyani had drawn significant attention because of Mr Liew’s status, Mr Heng repeated the point in Mr Shanmugam’s Ministerial Statement that the case was handled like any criminal investigation, although it had shown where there could be improvements in the work of the police and the Attorney-General’s Chambers.

 

Mr Heng added that the case illustrated how the Singapore justice system worked. He said: “This case shows that our criminal justice system as a whole works. The Government will uphold the rule of law, protect the integrity of our institutions, and continuously improve to ensure fairness, justice and equality before the law.”

Xiong Jiawei, 28, was charged in 2019 with masturbating in front of a woman at the university’s Science Library.


SINGAPORE — An arrest warrant has been issued for a 28-year-old chemical engineering student from the National University of Singapore (NUS), who was charged last year with masturbating in front of a woman at the university’s Science Library.Xiong Jiawei, a Singapore permanent resident, absconded to his home country of China and has no intention of returning here, his former lawyer Gino Hardial Singh told TODAY.

 

Court documents had previously described Xiong as Singaporean but his lawyer clarified on Tuesday (Dec 8) that he is a PR here. A review of Xiong’s arrest warrant was held in the State Courts on Monday.


Mr Singh discharged himself as Xiong’s defence counsel during the last review in late October. He told the court then that Xiong left Singapore on Aug 31 without telling them. “We were only apprised of his whereabouts in China on the morning of Sept 1. We have been in constant touch with him and it has always been his position that he would be coming back to Singapore before his (plead guilty) date,” Mr Singh had said.However, when the lawyer pressed Xiong on Oct 21 for his return date, he said he did not intend to come back.

Offenders can be jailed for up to three months or fined, or both.

 

Court documents did not state the alleged victim’s age or whether she was a fellow student. She cannot be named due to a court order to protect her identity.

 

Xiong’s next arrest warrant review will take place on June 7.

 

Such warrants are issued by the courts to the police or other law enforcement agencies to arrest an alleged offender, in instances such as if they fail to attend court proceedings. Reviews are held if the accused person cannot be located.

This includes covering gaps in shower cubicles, increasing the number of security guards at hostels and installing new locks at the entrances of restrooms in hostels.

A man was spotted butt-naked and wandering around Bedok on Dec. 2.

A video sent in by a Mothership reader showed an elderly man walking — strangely enough — backwards.

Devoid of clothes, the man walked backwards from the traffic junction towards the residential buildings.

Passers-by nearby did not approach him.

The short clip was filmed from the vantage point of a double decker bus, and the Mothership reader said this was the first time he had seen such a thing in Singapore.

In response to Mothership's queries, the police said that they received a call for assistance along Block 89 Bedok North Street 4 at around 5:03pm that day.

A 57-year-old man was arrested for appearing nude in a public space.

Police investigations are ongoing.

And in the case of Zarara Lateef, Goh Chok Tong himself wrote a letter in support for her and she only got 2 months jail time.

Extremely brutal. Should hung or send for electrocution, otherwise get struck by lightning and burn in hell.   This type of human behavior should not exist.  Can you imagine the maid being someone daughter, mother or wife and treated inhumanly in foreign land just for a paltry amount of money to bring home?  I have problem understanding the nature of resorting to such brutality in Singapore and I thought this country is supposed to be first world standard.

In defence, the employer claimed to be Christian.

Anyway, the newspaper today reports no complaint from previous maid.

A social study on both sides may be warranted.

So as to not forget the prairie natives starved to death with the extermination of buffoles.

Woman admits killing maid; starved her to 24kg and assaulted her almost daily in 'utterly inhumane' case

 

 

Finding that the victim was slow, unhygienic and ate too much, Gaiyathiri established a strict set of rules that the victim had to obey. Initially, she responded to a breaking of these rules by shouting, but began physically abusing the helper from October 2015.

Closed-circuit television footage from cameras installed in the house to monitor the victim and the children showed the abuse carried out in the last 35 days of the victim's life.

 

She was given only little food including sliced bread soaked in water, cold food from the fridge or some rice, and allowed to sleep for about five hours a night. She lost 15kg during her employment, losing about 38 per cent of her body weight in about 14 months. 

She was given no privacy - being forced to shower and go to the toilet with the door open while Gaiyathiri or Prema watched - and wore multiple layers of face masks as Gaiyathiri found her dirty and did not want to look at her face.

 

Gaiyathiri assaulted the victim almost daily, often several times a day, by slapping, pushing, punching and kicking her. She also stamped on the helper while she was on the floor, and attacked her with objects including a broom, a metal ladle and other hard objects.

 

She also lifted the helper up by her hair, grabbed it and shook her violently and pulled out a clump of her hair. On one occasion in June 2016, Gaiyathiri approached the victim while she was ironing clothes and pressed the hot iron against her forehead. Before shifting the iron to the victim's forearm, Gaiyathiri said: "If you like to burn people thing, how would you like if I burn your hand".

 

The court was shown multiple clips of the abuse. The victim appeared frail and with her hair tied up in knots that Gaiyathiri would hold onto while flinging her around. She was shown doing her chores, with Gaiyathiri approaching her and assaulting her, throwing her around like a ragdoll. The victim did not retaliate.

 

During the 12 nights before her death, the victim had her hands tied by a string to a window grille, so that she would not leave the room. She was not given medical treatment for her wounds, and was last taken to a clinic in May 2016 for a runny nose, cough and swelling on her legs.

 

When the helper removed her face mask and sunglasses in the clinic, the doctor saw bruises around her eye sockets and cheeks, but Gaiyathiri explained these away by saying the victim fell down frequently as she was clumsy.

 

She turned down the doctor's suggestions for further tests of the victim's swollen legs, as there could be underlying conditions.

Stronger legislation plus enforcement are needed to protect low wage workers.

 

A maid, once hired by employers, disappears from the world. She can literally be locked up 24/7. Can there be compulsory yearly medical assessm? Is there option to not live-in with employers?

 

Spore needs to realise: young children watch how grown ups treat maids.
